A. 
The Departments of Police, Fire and Emergency Medical Services, the Beach Patrol, the Ordinance Enforcement Department and the Uniform Construction Code Enforcement Office shall be supervised and administered by the Director of Public Safety, under the direction of the Manager.
B. 
Vacancies in the office of Director of Public Safety shall be filled by the Manager. The Public Safety Director shall supervise the departments indicated. Supervision of the Chief of Police, the Chief of the Fire Department and the Uniform Construction Code Enforcement Office shall be in the manner permitted by law, and the Director of Public Safety shall not be considered to be the holder of the statutory position of such Chief of Police or Fire Department or Uniform Construction Code Official.
A. 
The Department of Police shall be supervised by the Chief of Police, which office and Department shall be organized and operated pursuant to N.J.S.A. 40A:14-118 and all other laws relative to the operation of law enforcement activities. The City Manager shall supervise the operations and administration of the Department, and said City Manager shall be deemed the appropriate authority pursuant to N.J.S.A. 40A:14-118.

B. 
The Department of Police shall consist of the Chief and of subordinate and intermediate officers as are authorized by the City Council, including the ranks of:

The subordinate officers, in order of rank and designation and according to the priority among offices of equal rank so established by the Chief of Police, the Director of Public Safety and the Manager, shall assume the command of the Department of Police in the absence of the Chief of Police. All officers shall be sworn in the manner required of the State of New Jersey and shall further carry out the orders of superior officers and agencies appointed to serve or having jurisdiction over them. All officers shall observe the rules and regulations of the Department of Police promulgated for the proper conduct of the affairs of the Department and the administration of justice.
D. 
Vacancies in all ranks of the Police Department shall be filled by the Manager.
A. 
The Department of Fire and Emergency Medical Services shall be supervised by the Chief of the Department. The Director of Public Safety, under the direction of the City Manager, shall supervise the operations and administration of the Department and the Chief.
B. 
The Department shall consist of the Chief and such subordinate and intermediate supervisory officers as are authorized by the City Council, which are:

D.

A. 
The Department of Beach Patrol shall be supervised by the Chief of the Beach Patrol. The Director of Public Safety, under the direction of the City Manager, shall supervise the operations and administration of the Department and the Chief.
B. 
The Department shall consist of a Chief and such subordinate and intermediate supervisors and officers as are authorized and placed by the City Council. Said subordinate positions, if filled, shall include the following:
(1) 
Assistant Chief.
(2) 
Captain.
(3) 
Senior Lieutenant.
(4) 
Lieutenant/Medic.
(5) 
Lieutenant.
(6) 
Lifeguard assigned and designated to perform additional duties, including maintenance of beach patrol equipment, instructions and patrol officers/ E.M.T.
C. 
The subordinate officers, in order of rank and designation and according to the priority among officers of equal rank so established by the Chief, the Director of Public Safety and the Manager, shall assume the command of the Department in the absence of the Chief. All officers shall be sworn in as required by law and the ordinances of the City of Brigantine.
D. 
Vacancies in all ranks of the Department shall be filled by the City Manager.
A. 
Zoning Enforcement Officer.
(1) 
The Director of Public Safety, under the direction of the Manager, shall supervise the activities of the Zoning Enforcement Officer, who shall perform all duties required by the Municipal Land Use Law[1] and the peculiar ordinances of the City of Brigantine relative to the development and use of land.

The Zoning Officer may be assigned duties as the State Housing Inspector for multiple dwellings as is required by law.
(3) 
Vacancies in the office of Zoning Officer shall be filled by the Manager.
B. 
Mercantile Licensing Officer.
(1) 
The Director of Public Safety, under the direction of the Manager, shall supervise the activities of the Mercantile Licensing Officer, who shall perform all duties required by the Mercantile Licensing Ordinance of the City of Brigantine.[2]

Vacancies in the office of Mercantile Licensing Officer shall be filled by the Manager.
C. 
Health Code Officer.
(1) 
The Director of Public Safety, under the direction of the Manager, shall supervise the activities of the Health Code Officer, who shall perform all duties required by the health and safety laws of the State of New Jersey, to the extent permitted by law, and those required by the health and safety ordinances of the City of Brigantine.
(2) 
The Health Code Officer shall also serve as the Secretary of the Board of Health representative to the Board of Health having jurisdiction over the City of Brigantine.
(3) 
Vacancies in the office of Health Code Officer shall be filled by the Manager.
D. 
Animal Control Officer.
(1) 
The Director of Public Safety, under the direction of the Manager, shall supervise the activities of the Animal Control Officer, who shall perform all duties required by the animal control laws of the State of New Jersey and those required by the Animal Control Ordinances of the City of Brigantine.[3]

(2) 
Vacancies in the office of Animal Control Officer shall be filled by the Manager.
E. 
Noise Control Officer.
(1) 
The Director of Public Safety, under the direction of the Manager, shall supervise the activities of the Noise Control Officer, who shall perform all duties required by the noise control laws of the State of New Jersey and those required by the Noise Control Ordinances of the City of Brigantine.[4]

(2) 
Vacancies in the office of Noise Control Officer shall be filled by the Manager.
F. 
Recycling Coordinator and Control Officer.
(1) 
The Director of Public Safety, under the direction of the Manager, shall supervise the activities of the Recycling Coordinator and Control Officer, who shall perform all duties required by the recycling laws of the State of New Jersey and those required by the Recycling Ordinances of the City of Brigantine.[5]

(2) 
Vacancies in the office of Recycling Coordinator and Control Officer shall be filled by the Manager.
A. 
The Uniform Construction Code Officer shall be supervised by the Construction Official, who shall possess such licenses as are required to act as a Construction Official under the New Jersey Uniform Construction Code Act[2] and applicable subcodes thereof. The Director of Public Safety, under the Direction of the Manager, shall supervise the administration and operations of the Construction Office.

B. 
The Construction Official, under the direction and supervision of the Public Safety Director and the Manager, shall supervise and coordinate the activities of all third-party inspectors and firms contracted for the purpose of providing required inspection and plan review services.
C. 
The Construction Official shall account for and maintain such funds as are collected in and for all such activities of the Department.
D. 
Vacancies in the office of the Construction Official shall be filled by the Manager.

The Emergency Management Services Office shall be supervised by the Coordinator, Emergency Management Services. The Director of Public Safety, under the direction of the Manager, shall supervise the administration and operations of the Emergency Management Services Officer.
B. 
Vacancies in the office of the Emergency Management Services Officer shall be filled by the Manager.
C. 
The Emergency Management Office is hereby reestablished in the City of Brigantine.
(1) 
Findings. The City of Brigantine is threatened by potential disasters of unprecedented size and destructiveness, resulting from fire, flood, hurricane, tropical storm, plane crash, hazardous or toxic materials and other natural and man-made causes. In order to ensure that preparations of this City will be adequate to deal with such disasters and generally to provide for the common defense and to protect the public peace, health and safety and to preserve the lives and property of the residents of this City, it is hereby found and declared to be necessary to:
(a) 
Create an emergency management organization.
(b) 
Provide for the rendering of mutual aid to other municipalities within the State of New Jersey and adjoining states and to cooperate with the county and state governments with respect to carrying out emergency functions.
(c) 
Create an Emergency Operations Plan for all divisions of City government in the event of an emergency.
(2) 
Purpose and policy. It is further declared to be the purpose of this section and the policy of this City that all emergency functions of the state government, including its various departments and agencies, of the county government and of the other municipalities and private agencies of every type be included in the Emergency Operations Plan so that a comprehensive plan can be developed to make use of all available resources in the event that a disaster does occur.
(3) 
Creation of organization. It is the purpose of this section and the policy of this City to create an emergency management organization in conformity with the Civil Defense and Disaster Control Acts, as directed in N.J.S.A. App. A:9-30 through A:9-63, Chapter 438 of the Laws of 1953, as amended.
(4) 
Name of organization. The name of this organization shall be the "City of Brigantine Office of Emergency Management."
(5) 
Appointment of Coordinator; staff. The City Manager of the City of Brigantine shall be responsible for the appointment of a qualified Coordinator of this office, pursuant to state and federal guidelines as of the date of his/her appointment The City Manager shall appoint a Deputy Coordinator and other staff as may be needed to effectively operate this office, and the position of Deputy Coordinator and other staff shall be created within the emergency management organization. It is the responsibility of the staff, under the direction of the Coordinator, to create and test the Emergency Operations Plan and to be prepared to activate it whenever necessary.
(6) 
Duties of organization. The Officer of Emergency Management (OEM) shall carry out and enforce such orders, rules and regulations as issued by the City Manager or the chain of command, as outlined by the Emergency Operations Plan, under the authority of this section.
(7) 
Duties and responsibilities of Coordinator. The position of Emergency Management Coordinator is created by this section. The responsibilities, duties and authority of the Emergency Management Coordinator shall be:
(a) 
Planning, activating, coordinating and conducting disaster control operations within the City of Brigantine.
(b) 
Establishing, equipping, staffing and supervising the Emergency Operating Center.
(c) 
Coordinating the utilization of local resources and allied services and agencies in an emergency.
(d) 
Implementing mutual aid agreements, as appropriate.
(e) 
Alerting and activating, as required, the municipal organization upon receipt of warning or notification of an emergency situation.
(f) 
Requesting assistance from County Emergency Management when resources are insufficient to cope with an emergency.
(g) 
Other responsibilities, duties and authority as outlined in the Emergency Operations Plan.
