There is reestablished a Municipal Court in and for the City of Brigantine, pursuant to the Laws of the State of New Jersey, 1948, Chapter 264, as amended and supplemented.[1]

A. 
The Municipal Judge shall be an attorney at law of the State of New Jersey, eligible to serve as a Judge of the Municipal Court.
B. 
The Municipal Judge shall serve a term of three years commencing on January 1 of the year of first appointment, and continue to serve until a successor is appointed and qualified.
C. 
Vacancies in the office of the Municipal Court Judge shall be appointed by the City Council.
The name of the Court shall be the "Municipal Court of Brigantine, Atlantic County." The Court shall have such functions, powers, duties and jurisdiction as are set forth in the enabling legislation, all as amended and supplemented.
All sessions of the Court shall be held in the City Hall, Court and Council Chambers, City of Brigantine, at the time designated by the Court.
A. 
There shall be established the position of Clerk of the Municipal Court, who shall perform such functions and duties as shall be prescribed by law, by the rules applicable to Municipal Courts and by the Municipal Judge. Such duties shall include but not be limited to:
(1) 
Carrying out all rules, regulations, policies, procedures, accounting functions and report functions as are prescribed for the operation of a municipal court.
(2) 
Receiving and docketing all complaints made by law enforcement officers, citizens and others and scheduling the same for hearing; and interviewing all persons seeking to make complaints or referring the complainant to the appropriate law or ordinance enforcement officer.
(3) 
Attending Court; taking minutes or other required records of the proceedings; keeping and maintaining exhibits and evidence; and preparing and issuing summonses, warrants and commitments.
(4) 
Taking and preparing bail bonds; making inquiry as to sufficiency thereof; and receiving and accounting for fines and costs.
B. 
There shall be such Deputy Clerks of the Court as are necessary to carry out the duties of the Clerk.
C. 
Vacancies in the office of Clerk of the Court and Deputy Clerk shall be filled by the Manager.
