Pursuant to Section 11 of the Uniform Fire Safety
Act (P.L. 1983, c. 383),[1] the New Jersey Uniform Fire Code shall be locally enforced
in the City of Brigantine.

The local enforcing agency shall be the Bureau
of Fire Prevention, which is hereby created in the City of Brigantine
Fire Department.
The local enforcement agency shall enforce the
Uniform Fire Safety Act[1] and the codes and regulations adopted under it in all
buildings, structures and premises within the established boundaries
of the City of Brigantine, other than owner-occupied one- and two-family
dwellings, and shall faithfully comply with the requirements of the
Uniform Fire Safety Act and the Uniform Fire Code.[2]
The local enforcement agency established by § 175-2 of this chapter shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.

The local enforcement agency established by § 175-2 of this chapter shall be a part of the City of Brigantine Fire Department and shall be under the direct supervision and control of the Fire Official.
A.
Appointment of Fire Official. The local enforcement
agency shall be under the direct supervision of the Fire Official,
who shall be a member of the Brigantine Fire Department, in charge
of fire prevention and appointed by the Board of Commissioners. In
the City of Brigantine, the individual appointed as Fire Official
may also be the Fire Subcode Official appointed pursuant to the New
Jersey State Uniform Construction Code Act (P.L. 1975, c. 217).[1] Nothing in this chapter is intended to alter or affect
the position and responsibilities of the Fire Subcode Official, whose
duties and responsibilities are mandated by the New Jersey Uniform
Construction Code, or to merge the functions of the Bureau of Fire
Prevention in the Brigantine Fire Department with the Construction
Code Department, except where state law and regulation have mandated
such merger or overlap of jurisdiction and duties.

Term of office. The Fire Official shall serve for
a term of one year and shall be reappointed annually on a calendar-year
basis.

C.
Inspectors and employees. Such additional inspectors
and other employees as are found to be necessary to carry out the
functions of the local enforcing agency shall be appointed by the
City Council.

D.
Removal from office. The Fire Official, inspectors
and other employees of the enforcing agency shall be subject to removal
by the City Council for inefficiency or misconduct. Any person to
be so removed shall be afforded an opportunity to be heard by the
appointing authority or a designated hearing officer.

Pursuant to Sections 15 and 17 of the Uniform
Fire Safety Act,[1] any person aggrieved by any order of the local enforcement
agency shall have the right to appeal to the Construction Board of
Appeals of the County of Atlantic.

The permit fees established by the Uniform Fire Code for activities defined in N.J.A.C. 5:70-2.7 are as set forth in Chapter 210, Mercantile Businesses, Article II, Fees Schedule. Said permit fees shall be the same as set forth in the appropriate sections of the Uniform Fire Code.

Exemption from permit fees. All churches, schools,
municipal buildings and charitable institutions shall be exempt from
the payment of any permit fee.

C.
Collection of fees. All permit fees as set forth in Subsection A shall be payable to the Bureau of Fire Prevention of the City of Brigantine.

D.
Nothing in this chapter is intended to limit or replace
necessary fees due and payable to the Construction Inspection Department
of the City of Brigantine for inspections, reviews or services performed
by the Uniform Construction Code Enforcement Department or the Fire
Subcode Official or inspectors thereof.

E.
Smoke detector and carbon monoxide alarm compliance
inspection fees. Any fees charged for smoke detector and carbon monoxide
alarm compliance inspection shall be as set forth in the Uniform Fire
Code. The charge for any smoke detector or carbon monoxide alarm compliance
reinspection shall be an additional amount which shall be equal to
the amount charged for the original smoke detector or carbon monoxide
alarm compliance inspection, respectively.

In addition to the inspections, permits and
fees required pursuant to the Uniform Fire Safety Act, the Uniform
Fire Code and any other regulations of the Department of Community
Affairs, the following additional inspections shall be required:

Any and all business establishments not classified as life-hazard uses by the Uniform Fire Safety Act shall be classified as a non-life-hazard use. There shall be an annual registration required, and the payment of said registration fee shall be as set forth in the schedule of fees in Chapter 210 of the Code of the City of Brigantine.

Fire zones. There is hereby established by this section
of this chapter fire zones within the City of Brigantine as follows:
(1)
Krystal Beach, 39th Street and Ocean Avenue: 39 1/2
alley from Ocean Avenue, north end of paved area, curb to curb.
(2)
Steak 38 or any other business establishment located
at 3700 Brigantine Boulevard: 37th Street from rear of building, 75
feet toward Brigantine Boulevard, west side of street only.

The business establishment located at the Lighthouse
Circle in the former place of the Circle Tavern: Bayshore Avenue,
east from Lighthouse Circle to parking lot driveway.

Sanderlings Condominiums, 300 block, 44th Street:
from north corner of building to street end, west side of street only.

Boardwalk On The Bay, 32nd Street and Bayshore Avenue:
from driveway east on Bayshore Avenue to property line.

LaSammana Motel, 15th Street and Brigantine Avenue:
from Brigantine Avenue south on 15th Street to driveway.

Celebrities Resorts or any other business establishment
located at 15th Street and Ocean Avenue: from Ocean Avenue to bulkhead,
curb to curb.

Celebrity
Resorts. The front entrance way of the 14th Street South side of the
building, the boundaries shall be as follows: beginning at the center
line of a concrete stair located on the 14th Street South side of
the building serving as the main entrance to the property and extending
easterly for 26 feet from said concrete center line; extending westerly
for 35 feet from said concrete center line and extending northerly
from the base of said concrete stair for 28 feet.
