A. The
administrative and executive powers of the Village, including the
power of appointment of officers and employees, except the Village
Clerk, the Village Attorney and Treasurer and, in the County of Westchester,
officers and members of the Police Department, where such a department
has been established pursuant to law, are vested in an official to
be known as the "Village Manager," who shall be appointed by the Board
of Trustees and shall hold office during the pleasure of such Board.
He shall receive such compensation as shall be fixed by the Board
of Trustees. Notwithstanding any other provisions of law, the Board
of Trustees may also appoint the Village Manager to the office of
Village Clerk, to serve in such office at the discretion of such Board.
Superseding, to the extent necessary, the provisions of § 4-402
of the Village Law of the State of New York and § 5711-q
of the Unconsolidated Laws of the State of New York, the administrative
and executive powers of the Village shall include the power to supervise
the Village Clerk, Village Treasurer and Chief of Police, each of
whom shall report to the Village Manager, each of whom shall be subject
to the direction and control of the Village Manager.

B. Notwithstanding the foregoing, the Board of Trustees
of the Village of Mamaroneck may appoint a Village Manager for a term
not exceeding four (4) years from the date of such appointment, provided
that the person so appointed shall have served the Village of Mamaroneck
prior to such appointment for twelve (12) or more months, in any period
or periods, as Village Manager or discharged the duties of Village
Manager during the absence or inability to serve of a regularly appointed
Village Manager.
C. The Village of Mamaroneck acknowledges the requirement
of state law that no person shall be eligible for appointment as Village
Manager who is not a Village resident, and it further acknowledges
the provision of state law which allows that the Board of Trustees
of the Village of Mamaroneck may provide that its Village Manager
may reside within the county in which the Village is situated. Accordingly,
and in an effort to ensure that the most qualified person may be appointed
as Village Manager, the Board of Trustees of the Village of Mamaroneck
hereby provides that the Village Manager of the Village of Mamaroneck
may reside anywhere within the County of Westchester.

During the absence or disability of the Village
Manager or during a vacancy created in the office of Village Manager,
the Board of Trustees may designate any properly qualified person
who is, at the time of such designation, a full-time employee of the
Village of Mamaroneck to perform the duties of the office of Village
Manager during such absence, disability or vacancy. The individual
so designated pursuant to this section shall have all the administrative
and executive powers as those of the Village Manager while such person
is performing the duties of the Village Manager, but said person shall
at no time receive any additional salary or other compensation for
performing said duties, except in the case where such person shall
be performing the duties of the Village Manager for a period of time
in excess of three consecutive weeks, in which case additional salary
or compensation may be paid for the entire time such person is performing
such duties.
Notwithstanding anything contained herein or
any other law to the contrary, the Board of Trustees shall establish,
by local law, resolution or ordinance, such boards, commissions, councils
or committees as it deems necessary and shall establish the composition,
powers, duties and responsibilities of each and may, from time to
time, amend the same. The Board of Trustees shall appoint the members
of each such board, commission, council or committee. Any vacancy
shall be filled by the Board of Trustees for the unexpired term.

The Village Manager is hereby empowered to authorize
such Village employees as he may designate to issue and serve appearance
tickets in connection with the performance of their duties, subject
to such restrictions and regulations as he may impose.
