A. Every owner of or person who harbors or keeps a dog
within the limits of the Township of Brick shall report annually,
during the month of January of each year, his or her name or address
and shall give the name, breed, color, age and sex of each and every
dog owned or kept by such person. Effective January 1, 2009, each
dog shall be registered for a license upon payment of the sum of $10
in the case of a dog which has been neutered or spayed and $13 in
the case of a dog which has not been neutered or spayed, which sums
shall include the fee paid to the State of New Jersey. Until January
1, 2009, the licensing and registration fees shall remain $6 in the
case of a dog which has been neutered or spayed and $9 in the case
of a dog which has not been neutered or spayed. The owner or keeper
of each dog shall be furnished with a license tag which shall have
stamped upon it the year granted, the wording "Township of Brick,
D.L." and the number of the tag which shall correspond with the number
of the license issued to each owner or keeper. In addition to the
fee provided for the registration of any dog as hereinabove set forth,
an administrative charge of $1 for any dog registered after January
31 of each year shall be collected.
B. Any such owner or person may, however, subject to
the conditions stated aforesaid, apply for a license which shall have
a term of three calendar years from the date of issuance. Effective
January 1, 2009, the fee for such license shall be $26 for a dog which
has been neutered or spayed and $35 for a dog which has not been neutered
or spayed, which sums shall include the fee paid to the State of New
Jersey. Until January 1, 2009, the licensing and registration fees
shall remain $14 in the case of a dog which has been neutered or spayed
and $23 in the case of a dog which has not been neutered or spayed.
Application for such licenses shall be made during the month of January.
Where application has been made for such license in any month other
than January, the applicant shall be, in addition, subject to the
administrative fee above provided for.
C. No license shall, however, be issued for a period
of other than one year except where the application for such license
shall be accompanied by a certification from a licensed veterinarian
indicating that the dog to be licensed has been inoculated for rabies
and that such inoculation shall immunize said dog for the term of
the license applied for.
D. Notwithstanding any other provision, the annual fee
for any dog deemed to have been potentially dangerous in accordance
with N.J.S.A. 4:19-23 or such subsequent legislation as may be adopted
therefor shall be $500.
E. The administrative charge to be collected by the Clerk
pursuant to this section of the Code of the Township of Brick for
any dog registered after January 31 of each year shall be $1 for every
month or part thereof from January 31 until the date such dog is registered.

The Clerk shall keep a registry book and enter
therein the name and address of the owner or keeper, a description
of the dog or dogs and the number of the license tag issued; and a
duplicate or copy of such registration shall be sent monthly by the
Clerk to the poundkeeper, collector of dog licenses or dog keeper.
For each such license tag issued, the owner or keeper shall pay to
the Clerk the sum of $0.50.
Each dog shall be provided by its owner or keeper
with a collar or chain to which said license tag shall be securely
fastened. No dog shall be permitted to remain in the limits of the
Township of Brick unless registered, licensed and tagged and muzzled
if so ordered. Any owner or keeper failing to provide such collar,
tag or muzzle, if muzzling is required, shall be subject to a fine
or penalty hereinafter provided.

Whenever the Clerk of this Township shall deem
it necessary, he shall issue an order or proclamation prohibiting,
for a certain time, to be therein specified, all dogs from running
at large on any or all streets, highways or other public places in
this Township, and said Clerk may also order that all dogs must be
muzzled during such time as he may direct, which order or proclamation
shall be posted in five public places in the Township and published
in a newspaper as may be directed by said Clerk.
If any dog for which a license fee has been
paid shall be impounded for being at large without the license tag
or muzzle, and it shall appear, upon due proof, that a license was
procured and a collar and tag put on any dog or any such dog was muzzled,
but that such collar, tag or muzzle had been accidentally lost, the
owner or keeper of said dog may redeem such dog, if impounded, by
payment to the Township Clerk, for the use of the Township, of the
sum of $0.50 and the sum of $0.25 for another tag.

The Mayor with the advice and consent of the
Township Council shall have the power to appoint a dog license collector,
an Animal Control Officer and a poundkeeper for a period of one year
or for such shorter period as may be deemed advisable. It shall be
the duty of any such dog license collector, Animal Control Officer
or poundkeeper ascertain and report to the Township Clerk any owner
or keeper of a dog who has not registered any dog or muzzled any dog
as required herein, and he or they shall receive as compensation for
his or their service the sum of $0.25 for each and every dog registered
by or through him or them, in addition to fees prescribed by any other
ordinance of this Township.

As used in this article, the following terms
shall have the meanings indicated:
DOG
Any dog, bitch or spayed bitch.
DOG OF LICENSING AGE
Any dog which has attained the age of seven months or which
possesses a set of permanent teeth.

Notwithstanding the provisions of §
98-1, dogs used as guides for blind persons and commonly known as "Seeing Eye" dogs, dogs used to assist handicapped persons and commonly known as "service" dogs or dogs used to assist deaf persons and commonly known as "hearing ear" dogs shall be licensed and registered as other dogs hereinabove provided for, except that the owner or keeper of such dog shall not be required to pay any fee therefor.

Whenever any penalty is imposed by this article
on the owner or keeper of a dog, a fine not exceeding $50 shall be
imposed upon such owner or keeper or imprisonment in the County jail
in case of failure to pay said fine, one day for each $1 of fine imposed.
Where the Township has contracted with any agency or other entity
to carry out animal control on behalf of the Township, any employee
of such agency or entity may issue summonses for violations of this
article.
