The following words and phrases, when used in this chapter, shall have the meanings respectively ascribed to them in this section:
AUTHORIZED EMERGENCY VEHICLE
Vehicles of the Fire Department, police vehicles and ambulances.
BICYCLE
Every device propelled by human power upon which any person may ride, having two tandem wheels, either of which is more than 20 inches in diameter.
BUS
Every motor vehicle designed for carrying more than 10 passengers and used for the transportation of persons; and every motor vehicle, other than a taxicab, designed and used for the transportation of persons for compensation.
BUSINESS DISTRICT
The territory contiguous to and including a highway when, within any 600 feet along such highway, there are buildings in use for business or industrial purposes, including but not limited to hotels, banks, or office buildings, railroad stations and public buildings which occupy at least 300 feet of frontage on one side or 300 feet collectively on both sides of the highway.
CENTRAL TRAFFIC DISTRICT
The congested area of the City is hereby designated for the purposes of this chapter the "central traffic district," and such district shall consist of the following streets and avenues: Rock Island; Bickford and Choctaw between Rogers and London; and London, Wade, Russell, Woodson, Hayes and Rogers between Rock Island and Choctaw.
CONTROLLED-ACCESS HIGHWAY
Every highway, street or roadway in respect to which owners or occupants of abutting lands and other persons have no legal right of access to or from the same except at such points only and in such manner as may be determined by the public authority having jurisdiction over such highway, street or roadway.
CROSSWALK
That part of a roadway at an intersection included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs or, in the absence of curbs, from the edges of the traversable roadway. The word "crosswalk" also includes any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by lines or other markings on the surface.
CURB LOADING ZONE
A space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials.
DRIVER
Every person who drives or is in actual physical control of a vehicle.
FREIGHT CURB LOADING ZONE
A space adjacent to a curb for the exclusive use of vehicles during the loading or unloading of freight or passengers.
HIGHWAY or STREET
The entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel. The words "highway" and "street" are synonymous herein.
INTERSECTION
The area embraced within the prolongation or connection of the lateral curblines, or, if none, then the lateral boundary lines of the roadways of two highways which join one another at, or approximately at, right angles, or the area within which vehicles traveling upon different highways joining at any other angle may come in conflict. Where a highway includes two roadways 30 feet or more apart, then every crossing of each roadway of such divided highway by an intersecting highway shall be regarded as a separate intersection. In the event such intersecting highway also includes two roadways 30 feet or more apart, then every crossing of two roadways of such highways shall be regarded as a separate intersection.
LANED ROADWAY
A roadway which is divided into two or more clearly marked lanes for vehicular traffic.
MOTORCYCLE
Every motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground, but excluding a tractor.
MOTOR VEHICLE
Every vehicle which is self-propelled and every vehicle which is propelled by electric power obtained from overhead trolley wires, but not operated upon rails.
OFFICIAL TIME STANDARD
Whenever certain hours are named herein, they shall mean standard time or daylight-saving time as may be in current use in this City.
OFFICIAL TRAFFIC-CONTROL DEVICES
All signs, barricades, signals, markings and devices not inconsistent with this chapter placed or erected by authority of a public body or official having jurisdiction, for the purpose of regulating, warning or guiding traffic.
PARK or PARKING
The standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers.
PASSENGER CURB LOADING ZONE
A place adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers.
PEDESTRIAN
Any person afoot.
POLICE OFFICER
Every officer of the City Police Department or any officer authorized to direct or regulate traffic or to make arrests for violations of traffic regulations.
PRIVATE ROAD OR DRIVEWAY
Every way or place in private ownership and used for vehicular travel by the owner and those having express or implied permission from the owner, but not by other persons.
RAILROAD
A carrier of persons or property upon cars operated upon stationary rails.
RAILROAD TRAIN
A steam engine, electric or other motor, with or without cars coupled thereto, operated upon rails, except streetcars.
RESIDENCE DISTRICT
The territory contiguous to and including a highway not comprising a business district when the property on such highway, for a distance of 300 feet or more, is in the main improved with residences or residences and buildings in use for business.
RIGHT-OF-WAY
The privilege of the immediate use of the roadway.
ROADWAY
That portion of a highway improved, designed, or ordinarily used for vehicular travel, exclusive of the shoulder. In the event a highway includes two or more separate roadways, the term "roadway" as used herein shall refer to any such roadway separately but not to all such roadways collectively.
SAFETY ZONE OR ISLAND
An area or space officially set apart within a roadway for the exclusive use of pedestrians and which is protected or is so marked or indicated by adequate signs as to be plainly visible at all times while set apart as a safety zone or island.
SCHOOL BUS
Every motor vehicle owned by a public or governmental agency and operated for the transportation of children to or from school or privately owned and operated for compensation for the transportation of children to or from school; provided, however, that this definition of "school bus" shall not be extended to include buses normally used in City transit which may be used part time for transportation of school children during some portion of the day.
SIDEWALK
That portion of a street between the curblines, or the lateral lines of a roadway, and the adjacent property lines, intended for the use of pedestrians.
STAND or STANDING
The halting of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in receiving or discharging passengers.
STOP or STOPPING
A. 
When required, means complete cessation from movement.
B. 
When prohibited, means any halting even momentarily of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control sign or signal.
THROUGH STREET OR HIGHWAY
Every street or highway or portion thereof on which vehicular traffic is given preferential right-of-way, and at the entrances to which vehicular traffic from intersecting streets and highways is required by law to yield the right-of-way to vehicles on such through street or highway in obedience to either a stop sign or a yield sign, when such signs are erected as provided in this chapter.
TRAFFIC
Pedestrians, ridden or herded animals, vehicles and other conveyances, either singly or together while using any highway for purposes of travel.
TRAFFIC CONTROL SIGNAL
Any device, whether manually, electrically, or mechanically operated, by which traffic is alternately directed to stop and to proceed.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, except devices moved by human power or used exclusively upon stationary rails or tracks.
The City Manager, subject to any directions which the Council may give by motion or resolution, is hereby empowered to make regulations necessary to make effective the provisions of this chapter and other traffic ordinances of the City and to make and enforce temporary or experimental regulations to cover emergencies or special conditions. No such temporary or experimental regulation shall remain in effect for more than 90 days.
It shall be the duty of the Police Department to enforce the street traffic regulations of this City and all of the state vehicle laws applicable to street traffic in this City, to make arrests for traffic violations, to investigate accidents, and to cooperate with other officers of the City in the administration of the traffic laws and in developing ways and means to improve traffic conditions, and to carry out those duties specially imposed upon such department by this chapter and any other traffic ordinances of this City.
Officers of the Police Department, or such officers as are assigned by the Chief of Police, are hereby authorized to direct all traffic by voice, hand or signal in conformance with traffic laws and ordinances; provided that, in the event of a fire or other emergency or to expedite traffic or to safeguard pedestrians, officers of the Police Department may direct traffic as conditions may require notwithstanding the provisions of the traffic laws and ordinances.
Officers of the Fire Department, when at the scene of a fire or other emergency, may direct or assist the police in directing traffic thereat or in the immediate vicinity.[1]

It shall be unlawful to operate a vehicle of any kind upon a street of the City, unless such vehicle is licensed as required by state law and unless a valid license plate is displayed thereon as required by state law.[1]

No person shall drive any vehicle which is in such condition, so constructed or so loaded as to cause delay or be likely to cause delay in traffic, or as to constitute a hazard to persons or property, except by permit issued by the Chief of Police and in accordance with the terms of such permit.
No vehicle or object which injures or is likely to injure the surface of a street shall be driven or moved on any street.

A. 
No person shall drive or move on any road, street, or highway of this City any motor vehicle, including motorcycles, trailers, semitrailers, or pole trailers, which are licensed by the Oklahoma Tax Commission and operated on the roads, streets, or highways of this City or any combination thereof, unless said vehicle is bearing a valid official inspection sticker issued by an official inspection station licensed by the Department of Public Safety. The provisions of this section shall not apply to any house trailer which requires a permit to be moved upon the highways of this state.
B. 
Any person who violates the provisions of this section shall, upon conviction thereof, be subject to a fine of $60.
C. 
Police officers shall have authority to inspect and test any vehicle upon the streets of the City at any time to determine whether it is safe, whether it is properly equipped, and whether its equipment is in proper adjustment and repair.

A. 
In order to preserve the peace and tranquility of the City and its citizens, no parade/event consisting of four or more persons or two or more vehicles or other modes of conveyance shall occupy or march or proceed along or over any street, sidewalk, alley, or other public property within the City unless a permit is first obtained from the City Clerk. Such permit shall be applied for at least seven days in advance of the date upon which the parade/event is to be held. A permit fee of $20 shall be paid to the City Clerk for such permit.
B. 
Prior to the issuance of the permit, application shall be made to the City Clerk on the form prescribed, which shall be reviewed by the Police and Fire Departments, and coordinated with other City departments as necessary. Prior to the issuance of the permit, the City Clerk will require the applicant to furnish a certificate of insurance that the applicant has purchased insurance in a reasonable sum, indemnifying the City for any loss which may occur arising out of the parade/event.
C. 
The City Manager shall establish rules and regulations relating to access routes for the conducting of a parade and shall establish regular parade routes.
D. 
The City Manager is authorized to modify, restrict, or deny a parade/event permit whenever in his reasonable opinion the modifying, restricting, or denying of the parade/event permit is necessary because the granting of such permit would constitute a danger or risk to the public health, safety, and welfare.
E. 
It shall be a misdemeanor for any person to participate in any parade/event unless a permit has first been issued authorizing such parade.
F. 
Any person who violates the provisions of this section shall, upon conviction thereof, be subject to a fine of $100.[1]

A. 
There is hereby adopted by reference and made a part of the Code of Ordinances of the City of El Reno all of the provisions of Chapters 10, 11, 12, 13 and 14 of the Oklahoma Highway Safety Code, all as found in Title 47 of the Oklahoma Statutes, and including any amendments thereto, and additionally including the adopting of any statute in said chapters which provides for discretionary adoption by a municipality. All of the provisions found in these chapters are hereby adopted and incorporated herein by reference, and are enforceable by the City within the City limits as fully as if set out at length herein.
B. 
In the event that any ordinance of the City shall conflict with Chapter 10, 11, 12, 13 or 14 of the Oklahoma Highway Safety Code found in Title 47 of the Oklahoma Statutes, or any amendments thereto, then the provisions of Title 47 of the Oklahoma Statutes adopted herein shall be controlling.
C. 
In the event that penalties, incarcerations, fines, or costs imposed by Oklahoma Statutes are in excess of the limits allowed to be imposed by municipalities, then such penalties, incarcerations, fines, or costs allowable shall control.
D. 
In the event that a violation of the law under the Oklahoma Statutes constitutes a felony, then such a violation of the ordinances of the City shall constitute a misdemeanor rather than a felony.
A. 
City personnel or contractors, while repairing or improving the streets of the City, and City personnel and utility companies, when installing, improving or repairing lines or other utility facilities in the streets, are hereby authorized as necessary, subject to control by the City Manager, to close any street or section thereof to traffic during such repair, maintenance or construction and, in exercising such authority, shall erect or cause to be erected proper control devices and barricades to warn and notify the public that such street has been closed to traffic.
B. 
When any street has been closed to traffic under the provisions of Subsection A and traffic control devices or barricades have been erected, it shall be unlawful for any person to drive any vehicle through, under, over or around such traffic control devices or barricades, or otherwise to enter the closed area, except that the provisions of this subsection shall not apply to persons while engaged in such construction, maintenance and repair, and to persons entering therein for the protection of lives or property; provided that persons having their places of residence or places of business within such closed area may travel, when possible to do so, through such area at their own risk.
C. 
Whenever construction, repair or maintenance of any street or utility line or facility is being performed and the street is not closed to traffic in accord with this section, the City personnel, contractor or utility company concerned shall erect, or cause to be erected, traffic control devices to warn and guide the public, and every person using such street shall obey all signs, signals, markings, flagmen or other traffic control devices which are placed to regulate, control and guide traffic through the construction or maintenance area.[1]

No person shall authorize or knowingly permit a motor vehicle owned by him or under his control to be driven upon any highway by any person who is not authorized by law so to do, or to be driven or to stand or be parked in violation of any of the provisions of this chapter.
No person shall cause or knowingly permit his child or ward under the age of 16 years to drive a motor vehicle upon any highway, when such minor is not authorized by law so to do, or to violate any provision of this chapter.
It is unlawful and a misdemeanor for any person to do any act forbidden or fail to perform any act required in this chapter.

A. 
If a police officer observes facts which he believes constitute a violation of the traffic ordinances of this City, committed by a resident thereof, in lieu of arresting such person, he may take his name, address, operator's license number, the registered license number of the motor vehicle involved, and any other pertinent and necessary information and may issue to him in writing, in form prescribed by the City Manager, a traffic citation embracing the above information and further stating the traffic violation alleged to have occurred and notifying him to answer to the charge against him in the Municipal Court within a reasonable time under the circumstances of the case, said time being specified in the citation. The officer, upon receiving the written promise of the alleged violator, endorsed on the citation to answer as specified, shall release such person from custody. If the person to whom a citation is issued fails to answer as prescribed in the citation, a complaint shall be filed and the case shall be prosecuted as provided in Chapter 28 of this Code.
B. 
If the alleged traffic violation is committed by a nonresident of this City, then the provisions of the Nonresident Violator Compact, 47 O.S. § 781, and the State and Municipal Traffic Bail Bond Procedure Act, 22 O.S. § 1115 et seq., shall apply, and said statutes are hereby incorporated by reference in this section.
C. 
If the alleged offense is a violation of an ordinance restricting or regulating the parking of vehicles, including any regulations issued under such an ordinance, and the operator is not present, the police officer shall place on the vehicle, at a place reasonably likely to come to the notice of the operator, a citation conforming substantially to that prescribed in Subsection A of this section, with such variation as the circumstances require. The operator of the vehicle shall be under the same obligation to respond to the citation as if it had been issued to him personally under Subsection A.
D. 
Whenever a person is halted by a peace officer or highway patrolman for any violation of this chapter punishable as a misdemeanor, the officer shall proceed in accordance with the State and Municipal Traffic Bail Bond Procedure Act, 22 O.S. § 1115 et seq.
E. 
If the person charged with the violation is a minor, then the citing police officer shall ascertain from the minor the name and address of his parents or legal guardian, and said officer shall cause a copy of the "violation" to be mailed to the address of the parents or legal guardian, within three days after the date of the violation, taking into consideration the circumstances of the case.

A Traffic Violations Bureau is hereby established as a division of the Office of the Clerk of the Municipal Court, to be administered by the Clerk, or by subordinates designated by him for that purpose. Persons who are cited for violation of one of the traffic regulatory ordinances of this City may elect to pay a fine in the Traffic Violations Bureau according to the schedule as set by Council in the form of a resolution.
