No person or persons shall bathe upon the oceanfront in the Borough of Spring Lake except at certain protected and established bathing beaches where lifeguards, boats, flags, buoys and other protective devices are provided.
No person or persons shall bathe from the designated bathing beaches within the Borough except at such time as the designated bathing beaches are protected by lifeguards.

No person or persons shall play ball or engage in rough athletics on the beachfront. Volleyball is permitted in areas designated by the Beach Manager or his/her designee.

A. 
No person or persons shall be disorderly on the beachfront or throw any bottles, cans, papers or other refuse of any description upon the beachfront.
B. 
No person shall smoke a cigarette, cigar, pipe or otherwise use tobacco products on the beachfront or boardwalk, any beach or boardwalk access pathway at any time.
No person or persons shall climb, break, deface or destroy or damage any fence or other property belonging to the Borough of Spring Lake.
Bathing in the waters of Wreck Pond, Wreck Pond Inlet, Lake Como and Spring Lake in the Borough of Spring Lake is prohibited.

A. 
No person shall possess any speargun in the area of the beach or the boardwalk at any time.
B. 
No person shall wear spiked footwear on the boardwalk at any time.
C. 
No person shall ride a bicycle on the boardwalk commencing on May 15 of each year and continuing thereafter to September 15, inclusive, of each year, except during the hours from 10:00 p.m. to 8:00 a.m., prevailing time, or each day. This does not apply to bicycles operated by the Borough of Spring Lake or its Police Department in carrying out the duties and responsibilities in protecting the health, safety and welfare of the general public.

D. 
Motorized bicycles.
(1) 
No person shall operate a motorized bicycle of any kind and by whatever name or designation known on the boardwalk or on the approaches to the boardwalk in the Borough. This complete prohibition shall be in full force and effect at all times.
(2) 
This amendment and supplement is not intended to apply to a motorized bicycle operated by the Borough in carrying out its duties and responsibilities in protecting the health, safety and welfare of the general public.
E. 
No person shall roller blade or skateboard on the boardwalk in the Borough of Spring Lake at any time of year.
F. 
No person shall ride, park, secure or otherwise leave unattended any bicycle on the boardwalk of Spring Lake between Worthington Avenue and St. Clair Avenue, or between Monmouth Avenue and Pennsylvania Avenue commencing on May 15 of each year and continuing thereafter to September 15, inclusive, of each year, except during the hours from 10:00 p.m. to 8:00 a.m. prevailing time, or each day. This does not apply to bicycles operated by the Borough of Spring Lake or its Police Department in carrying out the duties and responsibilities in protecting the health, safety and welfare of the general public.

G. 
During the months of July and August, Memorial Day Weekend (Friday through Monday) and Labor Day Weekend (Friday through Monday); no parties, weddings, gatherings, ceremonies or similar special events shall be permitted on any portion of the boardwalk, including any adjacent structures such as the Washington Avenue, and Newark Avenue Gazebo; North and South End Pavilions; and the Pier Beach Boardwalk Patio Area.

During the months of July and August, Memorial Day Weekend (Friday through Monday) and Labor Day Weekend (Friday through Monday); Beach parties, weddings, gatherings, ceremonies and similar events are prohibited on Borough beaches. Non-beach related items such as tables, upright chairs, stages, and podiums are prohibited on Borough beaches for any purpose.
No person or persons shall remain on the beach after the hour of 12:00 midnight, other than those persons who are actively engaged in surf-fishing.

Lifeguards shall be on duty at the bathing areas between 9:00 a.m. and 6:00 p.m. daily during the bathing season. When bathing shall be determined to be unsafe and prohibited the Beach Manager or his/her designee, flags shall be displayed and lifeguard stands shall be turned down indicating that the beaches are closed and unguarded.

No person or persons shall engage in surf-fishing in the bathing areas at any time.
No person or persons shall disrobe or dress or undress on the beachfront or in the water adjacent thereto or on public streets or in public places or motor vehicles or any other vehicles on the streets of the Borough or on or under the boardwalk immediately adjacent to the beachfront.
No person shall be permitted to enter the bathing areas or to bring any article or object on the bathing areas except through a designated entrance.
No person or persons shall take or remove any beach sand or soil from the beachfront.
A. 
No person or persons shall use surfboards or rafts or other appliances which might cause injury to bathers or swimmers upon the beach or the beachfront or in the waters adjacent thereto without permission of the lifeguard at the bathing area.
B. 
Surfboard riding shall be restricted at all times to those areas of the beach designated either by resolution of the Mayor and Council or by written direction of the Beach Manager.

No person shall bathe or swim in the Atlantic Ocean from the Spring Lake beach at a distance greater than that which the lifeguard in charge shall deem safe.
A. 
No scuba diving or similar activity shall be permitted in the Atlantic Ocean from the beaches of the Borough without permission from the Chief of Police.
B. 
Any person who has obtained permission from the Chief of Police to scuba dive and has produced the proper certifications for diving and who allows an uncertified person to use the scuba equipment shall be subject to the general penalty clauses of the Borough of Spring Lake. The clear intent of this is one card, one diver. Any violation will be prosecuted.
C. 
Divers shall not be permitted in any location where there are bathers.
A. 
The bathing season for the municipally operated beaches shall be determined and set each year by resolution of the Mayor and Council of the Borough.
B. 
Nothing herein shall require all municipally operated beaches to be open at the same times.

Fees for the use of beaches and pools shall be in accordance with the fee schedule resolution which shall be adopted annually by the Mayor and Borough Council. [1]

Every person using the beachfront of the Borough and the waters adjacent thereto during the bathing season (as determined in accordance with § 114-18) shall obtain a beach badge which shall be visibly worn by the individual at all times and which shall be exhibited upon request to Borough representatives and employees.
The Borough reserves the right to revoke any beach privileges granted under this article for cause and to retake and impound any beach identification badge or admission ticket which has been improperly used or obtained.

Fees for broken or lost badges shall be in accordance with the fee schedule resolution which shall be adopted annually by the Mayor and Borough Council.

Food is prohibited on all beaches within the Borough. Nonalcoholic beverages in nondisposable containers such as thermoses and squeeze bottles are permitted on all beaches within the Borough. Coolers are prohibited on the beach. No tents or canopies are permitted, only umbrellas with one central stanchion to support shade whether upright or a ninety degree position. Devices designed or used to shade infants, no larger than thirty six inches high by thirty six inches wide by thirty six inches deep are permitted for infant use only.
Bathers and all other persons, except those persons engaged in surf-fishing, are prohibited from going on the jetties in the Borough. Persons engaged in surf-fishing may not use the jetties, or that side of the jetties which is either in designated bathing areas or in the proximate bathing areas thereto, at such times as the beaches are open for bathing as set forth in this Chapter.

The Mayor and Council are authorized and empowered to adopt by resolution additional rules and regulations for the operation and maintenance of the beaches, pavilions, boardwalk and areas adjacent thereto and such additional rules and regulations shall be enforceable as any other provisions in the this section. To the extent deemed appropriate, notice of such additional rules and regulations shall be published and posted where all public notices are posted and, in addition thereto, at all municipally operated beaches and pools. In an emergency, either the Council Liaison for the Beachfront or the Beach Manager may promulgate necessary rules and regulations if deemed to be for the health, safety and general welfare of the public. Such emergency rules and regulations shall be reviewed and considered at the next regular or special meeting of the Mayor and Council at which time such rules and regulations may be confirmed, amended or revoked.

No person or persons shall peddle, vend, sell, distribute or offer for sale any goods, wares or merchandise on the dedicated beachfront or the public walk on the dedicated beachfront. This section does not apply to the three concessions leased by the Borough to the various concessioners at the North End Pavilion, South End Pavilion and Pier Beach.

No person or persons shall solicit any business on the public walk or dedicated beachfront.
No person or persons shall sell or distribute any leaflets, circulars, pamphlets or other printed matter upon the dedicated beachfront or on the public walk.
No person or persons shall use or tamper with any boat or other lifeguard equipment without the permission of the Captain of the Lifeguards, except in case of emergency.
A. 
The Beach Manager will regulate and control the beachfront as to determine whether bathing and/or surfing is to be permitted, restricted or closed after normal operating hours in correlation with this article. Lifeguards will remain on duty under the direction of the Beach Manager and the Lifeguard Supervisor. Beaches can be closed to bathing and/or surfing completely whereby lifeguards and police would keep people away from the dangerous surf or have restricted bathing and/or surfing in designated areas as determined by the Beach Manager and the Lifeguard Supervisor.

B. 
Under the direction of the Beach Manager and/or Lifeguard Supervisor, when lifeguards are told to secure and depart the beachfront, the lifeguards will advise the patrons that they are going off duty and to not go near the dangerous surf to swim or surf. The Beach Manager and/or Lifeguard Supervisor will notify Spring Lake Police Department that the lifeguards are off duty. The Rough Surf Management Plan will remain in effect until the surf conditions subside and normal beach operating conditions are in effect.

C. 
Rules and regulations. In addition to the rules and regulations hereinafter enumerated, the Borough Council is hereby authorized and empowered to adopt, by resolution, such other rules and regulations as may be necessary for the proper control and regulation of the beachfront and the waters adjacent thereto. The Borough Council is further authorized and empowered to suspend, modify and/or supplement, by resolution, for a limited time the operation of certain rules and regulations governing the beachfront and the waters adjacent thereto in order the permit or facilitate special events, activities, promotions or programs authorized by resolution of the Borough Council. The following rules and regulations are hereby established:
(1) 
No person shall bathe in the water adjoining the beachfront within the Borough of Spring Lake except in certain designated areas to be hereafter determined from time to time by resolution of the Mayor and Council and thereafter published in the beach regulations of the Borough of Spring Lake for the current season or as designated by signs or flags to be posted by the Beach Manager.

(2) 
No person shall bathe or swim from the beachfront except from the protected bathing beaches, as designated by flags or signs and where lifeguards are provided by the Borough of Spring Lake, and only at such times as the lifeguards are on duty.
(3) 
No person shall use or tamper with any boat or lifeguard equipment without the permission of either the Beach Manager or Lifeguard Supervisor.

(4) 
Lifeguards shall be maintained on duty at the protected bathing beaches hereinafter established between the hours of 9:00 a.m. and 6:00 p.m., prevailing time, except at such times when bathing or swimming shall be deemed dangerous or hazardous by either the Beach Manager or the Lifeguard Supervisor. When such dangerous conditions exist, a sign or red flag shall be displayed indicating that the beach is closed to bathing or swimming, and no person shall bathe or swim in said waters adjacent to the beach, whether protected or not, at any time until the signs or flags are removed. No person shall bathe or swim in the waters adjacent to the beach during the hours of darkness.

(5) 
Lifeguards shall have charge, control and supervision of the bathing, swimming and surfing at the respective designated beaches for the individual designated sports and generally on all the beaches and beachfront of the Borough and in the waters adjoining the same. It shall be a violation of this section for any person to refuse to obey or to disregard the oral or visual command, whistle or signal of any lifeguard not to enter the beaches, beachfront or waters adjoining the same, not to surf in the waters, not to swim or bathe beyond the designated swimming or bathing areas or in waters deemed hazardous or dangerous by the lifeguard, not to leave the waters or the beach or beachfront with or without paraphernalia or equipment, whether swimming, bathing, surfing or being thereon, as the case may be. The Borough shall provide beach patrols consisting of regular and/or special police officers.
Any person violating any section herein shall be subject to general penalties of the Borough of Spring Lake as set forth in Chapter 1, Article II, General Penalty.
