As used in this section, the following terms shall have the meanings indicated:
ALUMINUM CANS
Includes aluminum containers used for soda, beer or other beverages, and for prepared food.
CORRUGATED CARDBOARD
Includes cardboard of the type used to make cardboard boxes, cartons, pasteboard and similar corrugated and craft paper material.
GLASS
Includes all products made from silica or sand, soda ash and limestone, the product being transparent or translucent and being used for packaging or bottling of various matters excluding, however, blue glass or flat glass (commonly known as window glass), as well as light bulbs and ceramic plates or dishes.
HIGH-GRADE PAPER
Includes white and/or off-white stationery, and photocopy and computer paper.
LEAVES
Includes the foliage portion of trees, shrubbery and other vegetation free of limbs, stalks, branches (twigs) and vines.
MIXED PAPER
A. 
Includes magazines, catalogs, slick glossy advertising supplements, undeliverable or advertising mail, envelopes with or without windows, phone book white pages, wrapping paper (nonmetallic), NCR paper (carbonless copy paper).

From schools: letterhead, colored and white paper, construction paper, text books without hard covers, soft-cover workbooks, envelopes and all items listed above.
(2) 
From offices: fax paper, computer paper, colored and white copy paper, letterhead, envelopes and all items listed above.
B. 
The following items are not acceptable for inclusion in mixed paper: newsprint, corrugated cardboard, chipboard, blueprints, brown paper bags, phone book yellow pages, carbon paper, plastic bags, napkins, tissues and paper towels.
POURABLE BEVERAGE AND LAUNDRY PLASTIC CONTAINERS
Includes pourable liquid containers such as from milk, soda, juice, water and detergent. These containers are identified by the symbols 1 or 2 on the bottom of the container.
SOLID WASTE
Includes all garbage and rubbish normally produced by the occupants of commercial, industrial and residential properties and disposed of by private or public pickup.
TIN AND BIMETAL CANS
Includes all metal containers, which are magnetic in nature, commonly used to package food products.
It shall be mandatory for all residents who are owners, lessees and occupants of residential properties, business and industrial properties and of private, public and governmental institutions and buildings, to separate leaves, glass bottles and jars, aluminum cans, newspapers, all pourable beverage and laundry plastic containers and mixed paper, as hereinafter defined, from all other solid waste produced by such residences and nonresidential establishments for collection and ultimate recycling of these materials.
Nonresidential establishments shall develop separate handling systems for the storage and ultimate recycling of high-grade paper (photocopy, computer paper, stationery) and corrugated cardboard, in addition to the separation of the materials specified above.
No person shall be permitted to place any construction, demolition or land-clearing debris, which includes asphalt, concrete and wood waste (specifically stumps, large tree parts, pallets, large pieces of lumber) with other solid waste for landfill disposal. Such items will not be taken at the landfill.

In accordance with existing state regulations (N.J.A.C. 14A:3-11), all service stations, oil retailers and motor vehicle reinspection stations with used oil holding tanks shall accept up to five gallons at a time of used motor oil from persons changing oil from cars, small trucks, lawn mowers and motorcycles and shall post a sign informing the public that they are a used oil collection site.
In accordance with existing state regulations effective upon the final passage of this section, no person shall be permitted to place, bagged, boxed, loose or otherwise, any grass clippings at the Recycling Center. Further, grass clippings will not be allowed to be placed in the street but must be disposed of by the homeowner.
A. 
The position of Recycling Coordinator is hereby created and established within the Borough.
B. 
The Recycling Coordinator shall be appointed by the Mayor and Council for a term of one year expiring December 31 of each year. The term of the person first appointed as Recycling Coordinator shall expire December 31 of the year of that person's appointment.
C. 
The Recycling Coordinator, subject to the approval of the Mayor and Council, by resolution, shall establish and promulgate reasonable rules and regulations as to the manner, days and times for the collection, sorting, transportation, sale and/or marketing of the recyclable material in order to encourage the preservation of material resources while minimizing the cost of the recycling program to the Borough.
A. 
The Mayor and Council may use municipal personnel to collect recyclable material set forth herein at curbside and/or from a dropoff center and shall sell the recyclable material if a market exists thereto pursuant to N.J.S.A. 40A:11-1 et seq.
B. 
The Mayor and Council may elect to enter into agreements with qualified persons or corporations authorizing them to collect the recyclable material at curbside or from a dropoff center and to sell the recyclable material, provided that the amount of money realized exceeds the cost of collection.
A. 
Recyclable material, as defined herein, shall be the property of the Borough of Spring Lake once placed on the curbside or brought to a dropoff center.
B. 
It shall be a violation of this article for any person unauthorized by the Mayor and Council to pick up or cause to be picked up, the recyclable material, as defined herein. Each such collection in violation thereof shall constitute a separate and distinct offense punishable as hereinafter provided.
A. 
Anything herein to the contrary notwithstanding, any person, firm or corporation who is owner, lessee or occupant of a residential or nonresidential property may donate or sell recyclable material, as defined herein, to any person, partnership or corporation whether or not operating for profit. The person, partnership or corporation, however, shall not pick up recyclable materials at curbside or at a dropoff center.
B. 
A record of the disposed recyclable material must be submitted to this municipality of the types and quantities of materials recycled. Weight receipts and/or letters on official company stationery shall clearly describe the quantity and disposition of each material. These documents shall be turned over to the Recycling Coordinator no later than January 31 of the following year.
A. 
Any person, firm or corporation who violates or neglects to comply with any provision of this article or any rule or regulation promulgated pursuant thereto, shall be punishable upon conviction thereof, as provided in Chapter 1, Article II, General Penalty.
B. 
Each day such violation is committed or permitted to continue shall constitute a separate offense and be punishable as such.
C. 
The Recycling Coordinator and Police Department will be used to enforce this article. Residents will be urged to report dumping or persistent violators.
D. 
Any person who is not a resident of the Borough of Spring Lake who uses the recycling facility shall be deemed in violation of this article and subject to the penalties in this section.
