GENERAL REFERENCES

Water — See Ch. 215.
As used in this Article, the following terms shall have the meanings indicated:
AIR CONDITIONING
The cooling or dehumidification, or both, of space for human occupancy at temperatures not less than 60° F. through the use of water supplied by any Water District of the Town of Niskayuna.
AIR-CONDITIONING INSTALLATION
One or more air-conditioning units, the water for which passes through a common meter, whether or not the units are owned by the property owner, the tenant, or both.
AIR-CONDITIONING SEASON
Includes the period from April 15 to October 15 during each calendar year.
PERSON
Includes the singular and the plural, and shall also mean and include any person, firm, corporation, association, club, partnership, society or any other form of association or organization.
TON OF REFRIGERATION
The heat required to melt ice at the rate of one ton in 24 hours. One compressor horsepower shall be considered equivalent to one ton of refrigeration.
WATER-CONSERVING DEVICE
A cooling tower, spray pond, evaporating condenser or other equipment by which water is cooled and recirculated, thereby limiting the use of water from the mains to that amount lost through evaporation and the initial filling of the installation.
For the purpose of conserving water, it shall be unlawful for any person to install or to operate air-conditioning equipment without first conforming to the following regulations:
A. 
Any water customer who desires to install air-conditioning equipment requiring the use of water supplied by any water District of the Town of Niskayuna after the effective date of this chapter shall obtain approval of his installation and a permit to install the same from the Department of Water and shall give notice of completion of said installation. Upon being given notice of completion of said installation, an authorized representative of the Department of Water shall make an inspection of said installation. Any water customer who has installed air-conditioning equipment prior to the effective date of this chapter, shall notify the Department of Water of such existing installation within 90 days of the effective date of this chapter.
B. 
Any air-conditioning installation installed after September 1, 1957, shall be equipped with a water-conserving device in such a manner that water supplied by any Water District of the Town of Niskayuna will be used only for the initial filling of the installation, makeup required by evaporation or flushing purposes during the air-conditioning season.
C. 
Any air-conditioning installation installed prior to September 1, 1957, which does not comply with Subsection B for new installations shall be converted or modified to comply with the provisions of that subsection on or before April 15, 1958.
D. 
The Superintendent of Water of the Town of Niskayuna or his duly authorized representative shall, at all reasonable hours, be admitted to any premises using water for air conditioning for the purpose of inspecting the equipment in use therein, and he shall require compliance with this Article where any violation is found.
A. 
All premises in which air-conditioning installation is installed after September 1, 1957, shall be metered and shall be subject to the regular meter rates in accordance with the rules and regulations of the Water Department.
B. 
All premises having air-conditioning installations that are installed prior to September 1, 1957, and are not metered, shall be equipped with meters by April 15, 1958, and shall be subject to the regular meter rates in accordance with the rules and regulations of the Water Department.
C. 
All air-conditioning installations not equipped with water-conserving devices shall be subject to an annual demand charge of $20 per ton of rated capacity until such time as the installation is converted or modified in compliance with the provisions of this Article, and upon the completion of such conversion or modification, it shall be subject to the annual demand charge of $5.
D. 
All air-conditioning installations that are equipped with water-conserving devices shall be subject to an annual demand charge of $5.
E. 
Demand charges shall be in addition to the regular meter rates and shall be payable to the Water District of the Town of Niskayuna supplying said water. Bills shall be rendered October of each year.
This article shall apply to all persons using water for air conditioning supplied by any Water District of the Town of Niskayuna.
At locations where there are continued or repeated violations, the Superintendent of Water or his duly authorized agent will have the authority to discontinue the supply to the violator of water from Water District mains, in accordance with the rules and regulations of the Water Department.[1]

REFRIGERATION
The removal of heat from material or space to maintain temperatures therein of less than 60° F.
REFRIGERATION INSTALLATION
One or more refrigeration units, including any combination thereof, whether compressor or other type, by which heat is removed from material or space and from which accumulated heat is wholly or partially removed by the use of water supplied by any Water District of the Town of Niskayuna. For the purpose of calculating rated compressor horsepower, all units which are supplied by water supplied by any Water District of the Town of Niskayuna which passes through a common meter, whether or not the units are owned by the property owner, the tenant, or both, shall be considered a single installation.
WATER-CONSERVING DEVICE
A cooling tower, spray pond, evaporating condenser or other equipment by which water is cooled and recirculated, thereby limiting the use of water from the mains to that amount lost through evaporation and the initial filling of the installation.
WATER-REGULATING DEVICE
An automatic device so controlled as to provide the most economical use of water and which closes to prevent waste of water when the unit is not running. It shall also limit the maximum use of water to a predetermined rate not to exceed two gallons per rated compressor horsepower capacity, but not more than 7 1/2 gallons per minutes for the installation.
For the purpose of conserving water, it shall be unlawful for any person to install or to operate refrigeration equipment without first conforming to the following regulations:
A. 
Any water customer who desires to install or convert refrigeration equipment requiring the use of water supplied by any Water District of the Town of Niskayuna after the effective date of this chapter, shall obtain approval of his installation or conversion and a permit to install or convert the same from the Department of Water and shall give notice of completion of said installation or conversion. Upon being given notice of completion of said installation or conversion, an authorized representative of the Department of Water shall make an inspection of said installation or conversion. Any water customer who has installed refrigeration equipment prior to the effective date of this chapter shall notify the Department of Water of such existing installation within 90 days of the effective date of this chapter.
B. 
Any refrigeration installation with a total rated compressor horsepower of five horsepower or less, installed after September 1, 1957, which requires the use of water supplied by any Water District of the Town of Niskayuna, shall be equipped with a water-regulating device. Such installations installed prior to September 1, 1957, shall be so equipped on or before April 15, 1958.
C. 
Any refrigeration installation with a rated compressor horsepower in excess of five horsepower installed after September 1, 1957, which requires the use of water supplied by any Water District of the Town of Niskayuna, shall be equipped with a water-conserving device. Such installations installed prior to September 1, 1957, shall be so equipped on or before April 15, 1958.
D. 
The Superintendent of Water of the Town of Niskayuna or his duly authorized representatives shall, at all reasonable hours, be admitted to any premises using water for refrigeration for the purpose of inspecting the equipment in use therein, and he shall require compliance with this Article where any violation is found.

All refrigeration installations not equipped with water-conserving devices shall be subject to an annual demand charge of $10 per compressor horsepower rated capacity until such time as the installation is converted or modified in compliance with the provisions of this Article, and upon the completion or such conversion or modification, it shall be subject to the annual demand charge of $5. Demand charge adjustments shall be prorated as of the date of the completion of the conversion or modification.
D. 
All refrigeration installations that are equipped with water-conserving devices shall be subject to an annual demand charge of $5.
E. 
Demand charges shall be in addition to the regular meter rates and shall be payable to the Water District of the Town of Niskayuna supplying said water. Bills shall be rendered October 1 of each year.
This Article shall apply to all persons using water for refrigeration supplied by any Water District of the Town of Niskayuna.
