As used in this chapter, the following terms shall have the meanings indicated:
BOND
A performance bond duly issued by a bonding or surety company authorized to do business in New York and approved by the Town Board with security acceptable to the Town Board or a performance bond duly issued by the developer-obligor accompanied by security in the form of cash, certified check or United States Government bearer bonds deposited with the Town Board in the full amount of the obligation.
CUL-DE-SAC
A street or a portion of a street with only one vehicular traffic outlet.
EASEMENT
Authorization by a property owner for the use by another and for a specified purpose of any designated part of his property.
ENGINEER OR LICENSED PROFESSIONAL ENGINEER
A person licensed as a professional engineer by the State of New York.
LOT, DOUBLE-FRONTAGE
A lot with the rear and front lot line abutting an existing or proposed street right-of-way.
LOT LINE ADJUSTMENT
Any alteration of lot lines or dimensions of any lots shown on a plat previously approved by the Planning Board and filed in the office of the Schenectady County Clerk or any alteration of lot lines or dimensions of any lot of record.

LOT OF RECORD
Any lot which has been established as such by plat, survey, record or deed prior to the effective date of this chapter as shown in the records of the Office of the Assessor, Town of Niskayuna.

LOT, REVERSE-FRONTAGE
A lot with the rear lot line abutting an existing or proposed arterial highway or public reservation.
MASTER OR COMPREHENSIVE PLAN
A Comprehensive Plan, prepared by the Planning Board pursuant to § 272-a of the Town Law, which indicates the general locations recommended for various functional classes of public works, places and structures and for general physical development of the Town and includes any unit or part of such plan separately prepared and any amendment to such plan or parts therein.
OFFICIAL MAP
The map established by the Town Board pursuant to § 270 of the Town Law showing streets, highways and parks and drainage, both existing and proposed.
OPEN SPACE
That portion of a lot or site, unencumbered by buildings, structures, outdoor storage areas, and certain impervious surfaces, that is intended to provide light and air and is designated for either environmental, scenic or recreational purposes. Open space shall not be deemed to include driveways, parking lots or other surfaces designated or intended for vehicular traffic.

PARK
An area set apart for recreation of the public, to promote its health and enjoyment.

PLANNING BOARD OR BOARD
The Planning Board of the Town of Niskayuna.
PRELIMINARY PLAT
A drawing or drawings clearly marked "preliminary plat" showing the salient features of a proposed subdivision, as specified in § 189-24 of this chapter, submitted to the Planning Board for purposes of consideration prior to submission of the plat in final form and of sufficient detail to apprise the Planning Board of the layout of the proposed subdivision.
SECRETARY OF THE PLANNING BOARD
The Deputy Zoning Enforcement Officer of the Town of Niskayuna.
SKETCH PLAN
A sketch of a proposed subdivision showing the information specified in § 189-22 of this chapter to enable the subdivider to save time and expense in reaching general agreement with the Planning Board as to the form of the layout and objectives of these regulations.
STORMWATER POLLUTION PREVENTION PLAN (SWPPP)
A plan for controlling stormwater runoff and pollutants from a site during and after construction activities.

STREET
A way for vehicular traffic, whether designated as a street, highway, throughfare, parkway, thruway, road, avenue, boulevard, lane, cul-de-sac, place or however otherwise designated.
A. 
STREET, HALFA street that is 1/2 in width, in either paving or right-of-way.
B. 
STREET, LOCALA street intended to serve primarily as an access to abutting properties.
C. 
STREET, LOCAL COLLECTORA street which serves or is designed to serve as a traffic way for a neighborhood or as a feeder to a major street.
D. 
STREET, MAJORA street which serves or is designed to serve heavy flows of traffic and which is used primarily as a route for traffic between communities and/or other heavy traffic generating areas and designated in the Zoning Ordinance as "parkways and major and minor arterials."[1]
STREET PAVEMENT
The wearing or exposed surface of the roadway used by vehicular traffic.
STREET WIDTH
The width of right-of-way, measured at right angles to the center of the street.
SUBDIVIDER
Any person, firm, corporation, partnership or association who shall lay out any subdivision or part thereof as defined herein, either for himself or others.
SUBDIVISION
The division of any parcel of land into two or more lots, blocks or sites, with or without streets or highways, and includes resubdivision.
A. 
SUBDIVISION, MAJORAny subdivision not classified as a minor subdivision, including but not limited to subdivisions of five or more lots, or any size subdivision requiring any new street or extension of municipal facilities.
B. 
SUBDIVISION, MINORAny subdivision containing not more than four lots fronting on an existing street, not involving any new street or road or the extension of municipal facilities and not adversely affecting the development of the remainder of the parcel or adjoining property and not in conflict with any provision or portion of the Master Plan, Official Map or Zoning Ordinance,[2] if such exists, or these regulations.
SUBDIVISION PLAT OR FINAL PLAT
A drawing, in final form, showing a proposed subdivision containing all information or detail required by law and by these regulations to be presented to the Planning Board for approval and which, if approved, may be duly filed or recorded by the applicant in the office of the County Clerk or Register.
SURVEYOR
A person licensed as a land surveyor by the State of New York.
TOWN ENGINEER
The duly designated engineer of the Town of Niskayuna.
