A. Because of the potential public nuisance and public
health and safety concerns, it shall be unlawful for any person, firm
or corporation to collect, pick up or cause to be collected or picked
up or remove any garbage, recyclable materials and/or other waste
from the curbside or refuse container of another person without the
express written authorization of the Village of Elmsford. Each such
collection shall constitute a separate violation.
B. Nothing in this article shall prevent any person,
business or corporation from making arrangements for the private collection
of materials.

Any person committing an offense against any
provision of this article shall, upon conviction thereof, be guilty
of a violation pursuant to the Penal Law of the State of New York
and shall be subject to a fine of not less than $250 nor more than
$1,000, imprisonment for a term not exceeding 15 days, or both such
fine and imprisonment. Each and every violation of this article shall
constitute a separate and distinct offense hereunder.
