This chapter applies to all private swimming pools used and maintained for swimming or bathing purposes.
As used in this chapter, the following terms shall have the meanings indicated:
SWIMMING POOL
Any pool which is constructed, used or maintained to provide recreational facilities for swimming, bathing or wading, and which is capable of containing water to a depth greater than 18 inches, and all buildings and equipment and appurtenances thereto.
It shall be unlawful to construct or establish a private swimming pool, as herein defined, within the Borough of Rocky Hill, in the County of Somerset, without first having obtained a permit therefor in the manner hereinafter prescribed.
A. 
Private swimming pools shall be constructed of materials such that they may be maintained in a sanitary and safe condition at all times.
B. 
It shall be the responsibility of the owner of the private swimming pool to maintain the pool in such a condition as to prevent breaks in the structure or water from overflowing onto adjacent public or private property.
C. 
The water in any private swimming pool at all times when in use shall equal the standards as set forth in the latest recommendations of the American Public Health Association and the New Jersey State Department of Health.
D. 
At all times when the pool is in use the water shall be sufficiently clear to permit the entire bottom of the pool to be clearly visible from the walkways surrounding the pool.
E. 
The yard requirements for structures as described in the Rocky Hill Borough Zoning Ordinance shall apply to private swimming pools.[1]

A. 
All private swimming pools now existing or hereafter constructed or installed within the Borough of Rocky Hill shall be enclosed by a barrier that shall be compliant with the current International Building Code, New Jersey Edition. Said barrier shall be so constructed as to prevent, within reason, any person from gaining access beneath or through said barrier. Access gates or doors that are a part of the barrier shall also be compliant with the current International Building Code, New Jersey Edition.

B. 
The swimming pool gates or doors shall be kept closed at all times except when opened for the purpose of ingress and egress.

Each property owner upon whose property there now exists a private swimming pool as defined in this chapter shall supply and install a barrier around such pool, complying with the requirements of this chapter, within 60 days after the adoption of this chapter or any amendments thereto.
No artificial lighting shall be maintained or operated in connection with private swimming pools in such a manner as to be an annoyance to the occupants of neighboring properties.
Any person, corporation or other organization who shall violate, or cause to be violated, any of the provisions of this chapter shall, upon conviction thereof, be liable to imprisonment in the Somerset County Jail or in any place provided by the said Borough of Rocky Hill for the detention of prisoners, for any term not exceeding 90 days, or to a fine not exceeding $200, or both.[1]
