It is the intent of the Board of Commissioners to promote the general health, safety and welfare of the residents of the Township, and it is determined that the uncontrolled consumption of alcoholic beverages in public is detrimental to health and safety.
It shall be unlawful for any person to consume, whether inside or outside of a motor vehicle, in or upon public ways, parks, places or property within the Township any alcoholic beverage or to possess an open container of an alcoholic beverage.
The possession of an open container containing alcoholic beverages in and upon the public ways, parks, places or property of the Township shall be prima facie evidence of consumption of such beverages in violation of this article.
As used in this article, the following terms shall have the meanings indicated:
PUBLIC PROPERTY
Includes all property owned by the Township.
PUBLIC WAY OR PLACE
Every way or place open to the use of the public as a matter of right for the purpose of vehicular or pedestrian travel, including sidewalks, streets, highways, buildings other than those public buildings with a liquor license, parking lots, parks or recreation areas.

Any person found guilty, after hearing before a District Justice, of violating any provision of this article shall, upon conviction thereof, be punished by a fine of not less than $100 and not more than $1,000, plus costs of prosecution, and in default of payment of said fine and costs, shall be imprisoned for a period not to exceed 30 days.
