That a certain document, three copies of which are on file in the Office of Code Enforcement of Ridley Township, being marked and designated as the ICC Electrical Code-Administrative Provisions, 2006 edition, as published by the International Code Council, be and is hereby adopted as the Electrical Code of Ridley Township, in the State of Pennsylvania, for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of electrical systems as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Electrical Code on file at the Ridley Township Municipal Building are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes, if any, prescribed in § 120-2 of this ordinance.

Means of Appeal is deleted. A substitute procedure is adopted by resolution of the Board of Commissioners.
B. 
Additional definitions.
(1) 
"Electrical work" shall mean installation, construction, alteration, assembly of any device, equipment, apparatus or any other object which is used or intended to be used for the transmission of electric energy or impulse except when performed by or on behalf of any regulated public utility or any regulated radio or television transmission system on equipment, cables, wires or equivalent facilities or on electrical circuits connected to or supported by such equipment or facilities if the use of the equipment or facilities is required in the operation of or services rendered by the regulated entity. It shall not include the manufacture of any device, equipment, apparatus or other object used or intended to be used for the transmission of any electrical energy or impulse but shall include electrical wiring, systems connected to air-conditioning equipment, protective signaling devices and swimming pools.
(2) 
"Approved inspection agency" shall mean any electrical inspection agency approved by the Board of Commissioners by resolution.
C. 
Electrical registration required.
(1) 
No electrical work of any kind shall be performed within the Township by any person, firm or corporation until the person, firm or corporation who is to perform such electrical work obtains a current contractor registration. The applicant shall register his/her or its name and address and other pertinent information on a form to be submitted with the electrical registration application. A certificate of insurance in an amount not less that $1,000,000 shall be submitted with the application for registration. Upon issuance, such registration shall continue in full force and effect following its issuance to and including the 31st day of December in the year of issuance, unless sooner revoked.
(2) 
Any applicant who is refused a registration or whose registration is revoked prior to expiration shall have the right to appeal such action pursuant to the appeals section of this article. Failure to comply with the registration requirement in this section or evidence of unsatisfactory knowledge or performance pursuant to the requirements of the ICC Electrical Code shall be cause for revocation or refusal to issue or renew an electrical registration.
D. 
Requirements for electrical work.
(1) 
All electrical work in the Township shall be performed in accordance with the ICC Electrical Code requirements and standards.
(2) 
No person shall perform any electrical work in the Township unless he first obtains a permit from the Code Official. An applicant for a permit shall make application on a form supplied by the Township setting forth:
(a) 
The nature of the electrical work to be performed.
(b) 
The place where the electrical work will be done.
(c) 
Plans and specifications for the electrical work to be done.
(d) 
The name and address of the person who will perform the electrical work.
(e) 
Any other information which the Code Official deems necessary or desirable.
(f) 
Electrical drawings shall be required for all new commercial, public and industrial buildings and apartments. Drawings shall be sealed by a registered professional electrical engineer.
E. 
Exemptions. Maintenance work will not require a permit. "Maintenance" is defined as "changing of appliances within an existing wired outlet box."
F. 
Fees for registration and permits. Fees for electrical registration and permits required by this article shall be calculated using the fee schedule adopted by resolution of the Township Board of Commissioners.
G. 
Inspection and tests.
(1) 
All decisions as to whether or not electrical work complies with the provisions of this article shall be made by the Code Official or his designee, who is hereby authorized to stop any electrical work in progress and order the removal thereof if he shall determine that such work is not being installed in conformity with the provisions of the ICC Electrical Code and this article.
(2) 
Inspections and tests to determine whether the provisions of the ICC Electrical Code have been complied with shall be made by an inspecting agency. Upon completion of any electrical work, a certificate of inspection and approval shall be issued by an approved inspecting agency not later that five days after completion of the installation of the electrical work. Schedules of the fees charged by the approved inspecting agency shall at all times be kept on file in the office of the Code Official and open to the public for inspection.
(3) 
The Code Official shall not accept any certificate of inspection from an inspecting agency which has not been approved by the Board of Commissioners. The Board of Commissioners shall investigate the qualifications, methods of operation, completeness of inspection activity and type of report before approving any such inspecting agency.
H. 
Revocation notice. When the Code Official determines that reason(s) exist for the revocation of a permit, he shall serve notice upon the holder of such permit stating the nature of the violation and that compliance with all requirements shall be achieved within 10 days of receipt of said notice. The notice may also prescribe a course of remedial action.
I. 
Violations and penalties.
(1) 
In case any work for which a permit is required by this article is started prior to obtaining a permit, the fee specified shall be doubled. However, payment of such double fee shall not relieve any person or firm from fully complying with requirements of this article in the execution of the work or from any other penalty prescribed herein.
(2) 
Each day that a violation continues shall be deemed a separate offense.
(3) 
Any person, firm or corporation who shall violate or fail to comply with this article or the code adopted herein shall be guilty of a summary offense and punishable by a fine of not more than $1,000 for each offense or, in default thereof, may be imprisoned in the Delaware County prison for a period not to exceed 30 days.
J. 
Appeals. Any person, firm or corporation aggrieved by any decision of the Code Official arising out of this article or code adopted hereby may appeal from such decision according to the procedure adopted by resolution of the Board of Commissioners.[1]
