Pursuant to the authorization provided in Section 1502, Clause XLIV, of the First Class Township Code,[1] and in the interest of health, safety, morals, general welfare, cleanliness, beauty, convenience and comfort of the Township and its inhabitants, the owners of all real estate in the Township of Ridley on which there is located any shopping center, apartment house containing 10 or more apartments, or other commercial business containing an area of 10,000 square feet or more, that is located within 50 feet of a residentially zoned area, shall erect and properly maintain in good repair a masonry wall or ornamental fence not less than six feet in height, as a buffer between the commercial or apartment zone area and the residential zone area.

A. 
All persons required to erect such wall or fence shall be notified in writing to comply with the provisions of this article. Such notice may be served personally or by certified mail. If sent by certified mail, the mailing of such notice shall be sufficient, whether or not the owner accepts such mail.
B. 
Within seven days after the date on the notice, the owner of the property involved shall apply to the Secretary of the Township of Ridley for a permit, and the application therefor shall be accompanied by a sketch showing the proposed location of the wall or fence.
C. 
In the event that the Secretary, after advice from the Building Committee, determines that the proposed location of the wall or fence is not appropriate, the Secretary shall indicate the proper location thereof.
D. 
Upon approval of the location of the wall or fence, either as applied for or as relocated, as aforesaid, the permit shall be issued and said wall or fence shall be erected within 30 days after the issuance of the permit.
The failure or refusal of any owner of such real estate to apply for a permit, or the failure to erect and properly maintain such wall or fence, after seven days' written notice so to do, shall constitute a separate offense for each day that such violation continues. Said written notice shall be issued by the Secretary of the Township upon the direction of the Board of Commissioners to issue such notice.
Any person, firm or corporation who violates any of the provisions of this article shall, upon conviction before a District Justice, be sentenced to pay a fine not exceeding $1,000, plus costs of prosecution, and in default of payment of such fine and costs shall be imprisoned for a period not to exceed 30 days. Each day such a violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder.

All horizontal and vertical members of a fence shall be located on the interior side of the fence.
Prior to the erection of a fence, a permit must be obtained from the Township, the fee for which shall be established by the Township Manager and subject to periodic adjustments.
Any person, firm or corporation who violates any of the provisions of this article shall, upon conviction before a District Justice, be sentenced to pay a fine not exceeding $1,000, plus costs of prosecution, and in default of payment of such fine and costs shall be imprisoned for a period not to exceed 30 days.
