No person, persons, firm or corporation shall maintain, construct, repair or enlarge a cesspool on land within the Township of Ridley, or permit the maintenance, construction, repair or enlargement of the same on land or property owned or possessed by him, they or it within the said Township, unless the excavation, hole or other opening in the ground is covered by a suitable covering or surrounded by a fence not less than four feet in height at all times when the said cesspool is not actually in the course of construction, repair or enlargement. Nothing herein contained shall be construed to permit the maintenance of cesspools within the Township of Ridley where sewers are available to the said premises for sewage.

If any cesspool is being constructed, repaired or enlarged contrary to the provisions of this article, the Building Inspector of the Township of Ridley is hereby authorized to revoke any building permit issued to the builder or owner of any property on which the said cesspool is being constructed, repaired or enlarged, and the Plumbing Inspector of the Township of Ridley is hereby authorized to revoke any plumbing permit issued to the builder or owner of the property on which the said cesspool is being constructed, repaired or enlarged.
Any cesspool being maintained, constructed, repaired or enlarged without being covered by a suitable covering or surrounded by a fence not less than four feet in height is hereby declared to be a nuisance, and the Building Inspector of the Township is hereby required to give notice to the builder engaged in such maintenance, construction, repair or enlargement, or to the owner of the property on which said cesspool is being maintained, constructed, repaired or enlarged, to remove said nuisance or dangerous excavation, and in default of the builder's or owner's removing or abating said nuisance, the Plumbing Inspector is hereby directed to remove and abate the said nuisance by either filling in the excavation and covering the same with suitable material or erecting a fence around the same.
In the event it becomes necessary for the Plumbing Inspector of the Township to abate or remove any nuisance created in the maintenance, construction, repair or enlargement of a cesspool, the costs of abatement or removal thereof shall be paid by the owner or builder, and in default of payment thereof summary proceedings before a District Justice may be instituted to correct the costs of such abatement or removal.
