As used in this chapter, the following terms shall have the meanings indicated:
FIREARM
Any handgun, rifle, shotgun, machine gun, automatic or semiautomatic rifle, or any gun, device or instrument in the nature of a weapon from which may be fired or ejected any solid projectible ball, slug, pellet, missile or bullet or any gas, vapor or other noxious thing by means of a cartridge or shell or the igniting of flammable or explosive substances. It shall also include, without limitation, any firearm which is in the nature of an air gun, spring gun or pistol or other weapon of a similar nature in which the propelling force is a spring, elastic band, carbon dioxide, compression or other gas or vapor, air or compressed air, or is ignited by compressed air, and ejecting a bullet, missile or other projectile smaller then 3/8 of an inch in diameter, with sufficient force to injure a person.
No person shall discharge any firearm within the City of Brigantine except by permission of the Chief of Police for ceremonial firing of salutes.
This chapter shall not apply to any of the following individuals if a firearm is discharged in the performance of their official duties:
A. 
Members of the Armed Forces of the United States of America or of the National Guard.
B. 
Federal law enforcement officers.
C. 
Members of the State Police and members of the Marine Law Enforcement Bureau of the Division of State Police.
D. 
Any employee of a sheriff's department of the State of New Jersey.
E. 
Any employee of a county prosecutor's office.
F. 
Any employee of the Attorney General's office or the Division of Criminal Justice of the Department of Law and Public Safety, or the State Commission of Investigation or an inspector of the Alcoholic Beverage Control Enforcement Bureau of the Division of State Police.
G. 
Any state park or state conservation officer.
H. 
Any employee of a prison or jail or Department of Corrections.
I. 
Any member of the Brigantine Police Department.
J. 
Any juvenile corrections officer employed by the Juvenile Justice Commission.
K. 
A designated employee or agent for a nuclear power plant under the license of the Nuclear Regulatory Commission.
L. 
Any person using legally authorized force for the protection of persons or property as set forth in N.J.S.A. 2C:3-1 et seq.
Any person violating the provisions of this chapter shall be subject to a fine not to exceed $1,500, imprisonment in the county jail for a term not to exceed 90 days and community service for a period not to exceed 90 days, or any combination thereof in the discretion of the Municipal Court Judge.
