No owner of land shall permit a swimming pool, or similar body of standing water intended for recreational use to be constructed or maintained in violation of this chapter. Any swimming pool that is not fenced in accordance with §
205-5 of this chapter at the time of adoption of this chapter must be in compliance within two months of passage of this chapter.
As used in this chapter, the following terms
shall have the meanings indicated:
SWIMMING POOL
A water-filled enclosure, permanently constructed or portable,
having a depth of more than 18 inches below the level of the surrounding
land, or an above-surface enclosure having a depth of more than 30
inches that is designed, used, and maintained for swimming and bathing.

Private swimming pools shall:
A. Be located on a lot on which there is situated a dwelling.
B. Be located so that the distance from the water's edge
to the rear lot line is 25 feet and so that the distance from the
water's edge to the side lot line is 10 feet.

C. Not be located within a front yard area, as defined in Chapter
234.
Swimming pools to which the general public of
the Town of Bridgeville, or residents of a particular community or
subdivision, or members of a club or community organization, have
access shall be approved by the Town Commissioners.
Water from the swimming pools shall not be drained
into the ground. If the owner of a swimming pool wishes to drain the
pool into the Town's sanitary sewer or into the storm sewer, he or
she must first advise the Public Works Department of the Town. The
Public Works Department may set certain conditions on the time and
method of draining. A chemical analysis to determine whether the water
to be drained would be harmful to the treatment facility or aquatic
life must be performed by a certified laboratory at the owner's expense.
The Public Works Department may assess a fee if the water is to be
deposited into the sanitary sewer. The fee shall be based upon the
fees charged for other sewage and must be paid in advance.

A. Pool meters are available at the Town Office for Town
residents to use when filling a swimming pool. Residents who use the
pool meter will benefit from not having to pay sewer fees on the amount
of water that flows through the pool meter.
B. Pool meters may be used once a year for a period of
one week. Each pool meter user shall sign a user agreement prior to
the Town's issuance of the pool meter. There is no rental charge to
use the meter.

A. The owner of such land where a swimming pool will
be used and maintained shall apply for and have approved a building
permit from the Building Official of the Town of Bridgeville, prior
to commencement of construction. Approval of such permit does not
imply any liability on the part of the Town of Bridgeville, in the
case of any future liability, criminal, or any other form of legal
dispute that may arise.
B. Inflatable pools do not require a building permit
but must meet all requirements set forth in this chapter.

Any person violating any provision of this chapter, upon conviction thereof, shall pay such fines as set out in Chapter
1, General Provisions, Article
II, Penalties.
