Any person who shall own, keep or harbor a dog of licensing age, as defined in N.J.S.A. 4:19-15.1 et seq., shall, in the month of January each year, apply to the Borough Clerk for a license and registration tag for each such dog. Such licenses and registration tags shall be issued pursuant to and in accordance with the provisions of state statute, and all dogs shall be kept and controlled in the manner provided for in such statute and be subject to all the provisions thereof.

A. 
Pursuant to said statute, the annual license fee for any spayed/neutered dog, and each renewal thereof, shall be $10, including those fees prescribed by state law for population-control funds. Pursuant to said statute, the annual license fee for any non-spayed/neutered dog, and each renewal thereof, shall be $13, including those fees prescribed by state law for population-control funds.

B. 
From February 1 until March 31 of each year, there shall be an additional late registration fee in the amount of $5, but the applicant shall not be subject to a summons.
C. 
After March 31 of each year, in addition to the fees and late registration fee set forth above, an applicant shall be subject to a summons and fine.
D. 
Only one license and registration tag shall be required in any licensing year for any dog owned and licensed in the State of New Jersey, and such license and tag shall be accepted by the Borough as evidence of compliance with this section.
E. 
In the event that a procured license or registration tag is lost, a fee of $5 shall be charged for the replacement thereof.

F. 
The annual fee for a potentially dangerous dog license and renewal thereof shall be $500.

G. 
All other license fees shall be as provided in said statute, and all said fees and other funds collected shall be received and disposed of in accordance with said statute.

The Borough Council may hereafter, by resolution, establish a pound and shall appoint a Dog Warden, who shall hold office for such length of time, perform such duties and receive such compensation as the Council may hereafter, by resolution, from time to time determine. Any dog taken into custody and impounded as provided in said statute shall be kept in said pound, if established, or in any private pound, or with some person or persons hereafter by resolution designated by the Borough Council, in the manner provided for and subject to the provisions of said statute.

A. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
ALLENDALE VOLUNTEER GOOSE PATROL (AVGP)
As defined and set forth in Chapter 6, Article V, of the Borough Code.
CUSTODIAN PREMISES
The residence or premises of the dog custodian.
DOG CUSTODIAN
The owner, caretaker, service provider, or person responsible for immediate care and control of a dog's care, behavior, and activities.
RUNNING AT LARGE
Any dog not confined or secured by a leash.
B. 
Running at large.
(1) 
Except as set forth in this article, no person owning, keeping or harboring any dog, shall suffer or permit such dog to run at large within the limits of the Borough of Allendale.
(2) 
The provisions of Subsection B(1) hereinabove shall not apply to:
(a) 
Law Enforcement and Emergency Services dogs.
(b) 
Allendale Volunteer Goose Patrol (AVGP) who are properly registered, wearing their assigned vest and working within an AVGP-approved area.
(c) 
A dog while within its custodian premises.
C. 
Prohibited locations.
(1) 
Except as set forth in this article, dogs are prohibited in the following locations:
(a) 
Celery Farm.
(b) 
Crestwood Park Playground.
(c) 
Crestwood Lake sandy beach.
(d) 
Recreational fields designated as:
[1] 
Fields 1, 2 and 3, located in the Allendale Recreational Park.
[2] 
Fields 4 (Kunisch), 5 and 6, located in Crestwood Park.
[3] 
West Maple Field, located in Crestwood Park.
[4] 
Multipurpose field, located in Crestwood Park.
(2) 
Exceptions. The provisions of Subsection C(1) hereinabove shall not apply to:
(a) 
Law Enforcement and Emergency Services dogs.
(b) 
Allendale Volunteer Goose Patrol (AVGP) who are properly registered, wearing their assigned vest, and working within any AVGP-approved area.
D. 
Defecation.
(1) 
No person owning, harboring, keeping or in charge of any dog shall cause, suffer or allow such dog to soil, defile, defecate on or commit any nuisance on any common thoroughfare, sidewalk, passageway, bypath, play area, park or any place where people congregate or walk, or upon any public property whatsoever, or upon any private property without the permission of the owner of said property.
(2) 
Exceptions. The provisions of Subsection D(1) hereinabove shall not apply to that portion of the street lying between the curblines, which such portion may be used to curb a dog under the following conditions:
(a) 
The person who so curbs such dog shall immediately remove all feces deposited by such dog by any sanitary method approved by the local health authority; and
(b) 
The feces removed from the aforementioned designated area shall be disposed of by the person owning, harboring, keeping or in charge of any dog curbed in accordance with the provisions of this article in a sanitary manner approved by the Borough Department of Health.
No person owning, keeping or harboring any dog, whether of licensing age or not or whether licensed or not, shall suffer or, permit such dog to do any injury or damage to the lawn, shrubbery, grounds or property of another within the Borough of Allendale.

The provisions of N.J.S.A. 4:19-7 through and including 4:19-36, amendments and supplements thereto, are hereby incorporated herein by reference. A copy of said statutory provisions shall be on file with the office of the Borough Clerk.

Any person violating this article shall be subject to a fine of no less than $200 and not to exceed $500 or to a term of imprisonment not to exceed 90 days, or both. The Police Department of the Borough of Allendale shall be the enforcement agency pursuant hereto.

No more than four dogs shall be sheltered or kept on any property having a single- or two-family dwelling. This limitation shall not apply to properly licensed pet shops, kennels, shelters and pounds.
