As used in this article, the following terms shall have the meanings indicated:
ALUMINUM CANS
Recyclable aluminum cans. Does not include pie plates, ferrous metal cans or other aluminum by-products.
BIMETAL CANS
Those materials made of steel and tin and being used for packaging of various matter.
CONSTRUCTION AND DEMOLITION DEBRIS
Source-separated, nonputrescible recyclable material generated from the construction, alteration, repair, maintenance and/or demolition of structures within the Borough of Allendale. This material shall include concrete, bricks, block, tree parts, ferrous and nonferrous scrap, asphalt, asphalt shingles, recyclable wood scrap, corrugated cardboard and any and all other material generated from the construction, where practical, alteration, repair, maintenance and/or demolition of a structure or structures within the Borough of Allendale.

CONTAINERIZED
The placement of yard waste in a trash can, bucket, bag or other vessel, such as to prevent the yard waste from spilling or blowing out into the street and coming into contact with stormwater.

CORRUGATED CARDBOARD
Cardboard of the type to make cardboard boxes, cartons, pasteboard and similar corrugated and kraft paper materials.
ELECTRONICS
Items including, but not limited to, computers, monitors, televisions, and radios.

FERROUS SCRAP
All metal scrap which contains steel or cast iron such as pipe, radiators, etc.
GLASS
All products made from silica or sand, soda ash and limestone, the product being transparent or translucent and being used for packaging or bottling of various matter and all other materials commonly known as "glass," excluding, however, blue and flat glass commonly known as "window glass."
GRASS
Those materials naturally formed from lawns that are suitable for composting and mulching purposes.
HIGH-GRADE OFFICE PAPER
White typing and ledger paper, white notepad paper, copier paper, carbonless computer paper, manila tab cards and file folders.
HOUSEHOLD-GENERATED BATTERIES
Any type of button, coin, cylindrical, rectangular or other shaped enclosed device or sealed container consisting of a combination of two or more voltaic or galvanic cells, electrically connected to produce electric energy, composed of lead, lithium, manganese, mercury, mercury oxide, silver oxide, cadmium, zinc, copper or other metals, or any combination thereof, and designed for household use, including any alkaline, manganese, lithium, mercuric oxide, silver oxide, zinc-air or zinc-carbon, battery, nickel-cadmium rechargeable battery or sealed lead rechargeable battery.

LEAVES
Those materials naturally formed from trees and shrubs that are suitable for composting and mulching purposes.
MIXED PAPER
All magazines, junk mail and other paper, excluding newsprint and kraft paper bags.
NEWSPAPER
Paper of the type commonly referred to as "newsprint" and distributed at stated intervals usually daily or weekly, having printed thereon news and opinions and containing advertisements and other matters of public interest. Magazines and periodicals as well as any other paper products are not considered "newspapers."
NONFERROUS SCRAP
All other metals which do not contain steel or iron such as aluminum, brass, copper, lead, etc.
PERSON
Any individual, corporation, company, partnership, firm, association, or political subdivision of this state subject to municipal jurisdiction.

PLASTICS
A hermetically sealed or airtight container with a metal or plastic cap; plastic containers commonly referred to as "one-, two- or three-liter bottles," "milk jugs," "laundry and dish detergent bottles," and all other plastics with a recycling symbol with the numbers 1 through 7 within the symbol.

SOLID WASTE
Includes all garbage and rubbish usually disposed of by regular scavenger service for the residential and nonresidential occupants of the Borough of Allendale.
STREET
Any street, avenue, boulevard, road, parkway, viaduct, drive, or other way, which is an existing state, county, or municipal roadway, and includes the land between the street lines, whether improved or unimproved, and may comprise pavement, shoulders, gutters, curbs, sidewalks, parking areas, and other areas within the street lines.

WHITE GOODS
All large appliances consisting primarily of metal such as washers, dryers, refrigerators, etc.
YARD WASTE
Leaves and grass clippings.

On and after the date fixed and promulgated by regulations issued as hereinafter provided and in accordance with the terms hereof, it shall be mandatory for all residential, commercial/industrial and institutional facilities to separate the designated recyclable materials as defined in § 228-1 and by the regulations and methods of disposal and collection as defined in § 228-3 from all other solid waste produced by any such facilities and to separately bundle such materials for pickup and collection for recycling.
A. 
Commercial, industrial and institutional. The owner or occupant in any commercial/industrial or institutional building within the Borough of Allendale who shall place for disposal, removal or collection the following items shall do so in strict conformity within the following regulations:
(1) 
High-grade office paper shall be separated and be disposed of by private contractor, commercial recycler or by arrangement with the Borough of Allendale through its Recycling Coordinator.
(2) 
Corrugated cardboard shall be separated and be disposed of by private contractor or commercial recycler.
(3) 
Glass, aluminum cans, bimetal cans and newspapers shall be disposed of by contracting privately or by arrangement with the Borough of Allendale through its Recycling Coordinator.
(4) 
Leaves and grass shall be recycled by composting or mulching on site or delivered to composting area by arrangement with the Borough of Allendale through its Recycling Coordinator.
(5) 
Ferrous and nonferrous scrap shall be disposed of by private contractor or commercial recycler.
(6) 
White goods shall be disposed of by private contractor, commercial recycler or by arrangement with the Borough of Allendale through its Recycling Coordinator.
(7) 
Construction and demolition debris shall be separated and disposed of by private contractor or commercial recycler. Upon acquiring the necessary Uniform Construction Code permit(s) for construction or demolition, it shall be the responsibility of the permit holder, owner, occupant or lessee of said property to recycle said materials as defined in § 228-1, Definitions. All subsequent records and or weight slips documenting the recycling of said materials shall be given to the Borough of Allendale's Municipal Recycling Coordinator before a certificate of occupancy can be issued.
(8) 
Mixed paper shall be disposed of by private contractor, commercial recycler or by arrangement with the Borough of Allendale through its Recycling Coordinator.
(9) 
Household-generated batteries shall be disposed of by private contractor, commercial recycler or by arrangement with the Borough of Allendale through its Recycling Coordinator.

(10) 
Yard waste shall follow regulations for leaves and grass pursuant to Subsection A(4) herein. The owner or occupant of any property or any employee or contractor of such owner or occupant engaged to provide lawn care or landscaping service shall not sweep, rake, blow or otherwise place yard waste in violation of these regulations nor place yard waste closer than 10 feet from any storm drain inlet.

(11) 
Plastic shall be disposed of by private contractor or commercial recycler.

B. 
Residential. Disposal and collection of the following recyclable materials shall be in conformity with the rules, regulations and schedules as authorized herein.
(1) 
Aluminum cans shall be placed in reusable containers for curbside collection. The reusable container shall be placed at curbside on the designated days to be collected by municipal employees.
(2) 
Clear, green and amber glass shall be placed in reusable containers for curbside collection. The reusable containers shall be placed at curbside on the designated days to be collected by municipal employees.

(3) 
Newspapers shall be bundled separately, secured by string or twine. Newspapers shall not be bundled in plastic or kraft-type bags. Newspapers shall be placed curbside on the designated days.
(4) 
Grass shall be recycled by composting or mulching on site or lawfully delivered to the composting area.
(5) 
Leaves shall be recycled by composting or mulching on site or voluntarily delivered to the composting area. Leaves shall be collected curbside in biodegradable paper bags for collection on the designated days, collection to be by municipal employees.

(6) 
Bimetal cans shall be placed in reusable containers for curbside collection. The reusable container shall be placed at curbside on the designated days, to be collected by municipal employees.
(7) 
Type 1 and Type 2 plastics shall be placed in reusable containers or clear plastic bags for curbside collection. The reusable container and or clear plastic bags (closed and tied) shall be placed at curbside on the designated days to be collected by municipal employees.

(8) 
Mixed paper shall be delivered to the designated dropoff site on the designated days.
(9) 
White goods shall be placed curbside on the designated days to be collected by municipal employees or the designated municipal contractor.
(10) 
Corrugated cardboard shall be placed curbside on the designated days to be collected by municipal employees or the designated municipal contractor.
(11) 
Ferrous and nonferrous scrap shall be placed curbside on the designated days to be collected by municipal employees or the designated municipal contractor.
(12) 
Construction and demolition debris shall be separated and disposed of by private contractor or commercial recycler. C. 
Set-out time. For collection pursuant to a schedule announced by the Borough of Allendale, all approved containers must be placed at the curbline where easily accessible. No materials shall be set out prior to 6:00 a.m. on the day of collection and any and all containers shall be removed by 8:00 p.m. on the collection day. When a regular collection day falls on a holiday, materials shall not be set out until the next scheduled collection day.
D. 
Washing/rinsing. All aluminum and bimetal cans, glass containers and plastic bottles shall be reasonably rinsed or washed to be free of all food and product residue before placing at curbside.
E. 
Townhouse and apartment complexes. Residents shall place recyclable materials per Subsection B(1), (2), (3), (6) and (7) in the designated areas within the respective complex for collection on the designated days. Recyclable materials per Subsection B(4) shall be composted on site or lawfully delivered to the compost site. Recyclable materials per Subsection B(5) shall be composted on site, voluntarily delivered to the compost site or placed at the curb for collection on the designated days for curbside collection. Recyclable material per Subsection B(8) shall be dropped off at the recycling dropoff site at 300 West Crescent Avenue (compost site) on the designated days. Recyclable material per Subsection B(12) shall be disposed of by private contractor or commercial recycler. Recyclable materials per Subsection B(9), (10) and (11) shall be placed curbside for collection on the designated collection days.
F. 
Procedure upon refusal to collect.
(1) 
Any solid waste placed for collection by a residential, commercial/industrial or institutional user not in accordance with this section will not be collected by the municipal collector or its designated contractor. It shall be the responsibility of the user to remove said solid waste from the curbline by 8:00 p.m. on the day of collection and have it properly containerized, packaged or secured for purposes of collection on the next scheduled date.
(2) 
Any and all recyclable materials found not to be in accordance with this section will not be collected by the municipal collector or its designated contractor. It shall be the responsibility of the user to remove said materials from the curbline by 8:00 p.m. on the day of collection and have it properly sorted and containerized, packaged or secured for purposes of collection on the next scheduled date.

A. 
Allendale Borough residents wishing to utilize the municipal composting facilities of the Borough pursuant to Chapter 228 of the Borough Code shall, in person, apply and secure an annual permit to and from the Borough Clerk, subject to the following provisions:
(1) 
The issuance of such permits shall be limited to legal residents of the Borough of Allendale.
(2) 
Documentation and information, including but not limited to the license plate number of the primary vehicle to be used to transport compost and a valid driver's license or other such identification as required for residential verification, may be requested by the Borough prior to issuance.
(3) 
A fee of $30 shall be charged in exchange for said permit.
B. 
All permits shall be nontransferable and may not be used by anyone except the applicant securing the permit.
C. 
Disposal of compost by contractors, landscapers, or any business, even if that business is resident-owned, shall be prohibited.
A. 
Registration requirements. It shall be the responsibility of all owners, lessees and occupants of commercial/industrial or institutional properties to register with the Municipal Recycling Coordinator on forms provided by the Borough. New commercial/industrial and institutional users must file within 45 days of the issuance of a certificate of occupancy.
B. 
Reporting requirements. It shall be the responsibility of owners, lessees and occupants of commercial/industrial or institutional properties to report annually to the Recycling Coordinator on or before February 1, for the preceding twelve-month period of January 1 through December 31, the quantities of materials recycled.
C. 
Private contractor/commercial recycler contracts. If the commercial/industrial or institutional user is either unable or unwilling to secure a market and collector for the designated mandatory recyclable materials as defined in § 228-3A(1) through (9), the Borough of Allendale, through its Recycling Coordinator, may secure such markets. If the commercial/industrial or institutional user does not comply in securing a market or deems such markets as secured with the Recycling Coordinator as unacceptable, said commercial/industrial or institutional user shall be in violation and subject to § 228-8, Violations and penalties.

D. 
All landscape and lawn service contractors shall register each year (prior to March 31) with the Borough of Allendale through its Recycling Coordinator. Such contractor(s) shall report the amount of materials recycled and the name of the facility where such materials were recycled. Reporting shall be on an annual basis from January 1 through December 31 of each year on forms provided by the Borough. Such reports must be received by the Recycling Coordinator no later than March 1 of the following year. The term "landscape and lawn service contractor" shall mean and include any person, firm or corporation who or which conducts a business involving the cutting, raking, collection or removal of grass, leaves or any other similar type of vegetative waste located on any residential, commercial or industrial premises within the Borough of Allendale.

Nothing in this article shall be deemed to prohibit any owner, lessee or occupant of residential property of disposing of recyclable materials privately through a sale or gift, provided that in no event shall such recyclable materials be left at the curb for any private pickup, and further provided that in no event shall any such recyclable materials be disposed of as part of the solid waste pickup by the Borough of Allendale. Any and all persons disposing of such materials shall be required to maintain records of all weights and types of materials recycled. All records shall be given to the Borough of Allendale's Recycling Coordinator.
From the time recyclable materials are placed at the curbline by the owner, lessee or occupant for collection by the Borough of Allendale or its designated collector, such materials become the property of the Borough. It shall be a violation of this article for any person unauthorized to collect or pick up or cause to be collected or picked up any such materials for any purpose whatsoever once the same has been placed at the curb. Any and each such collection in violation hereof from one or more premises shall constitute a separate and distinct offense punishable as hereinafter provided.
The Recycling Coordinator, the Sanitation Officer, the Construction Code Official and members of the Police and Public Works Departments are hereby authorized and directed to enforce this article. The Borough Administrator is hereby authorized and directed to establish and promulgate by rules, regulations and schedule as to the manner, days and times for collection or delivery of recyclable materials as defined herein and initially, in accordance with the terms hereof. The Borough Council may, by resolution, change, modify, repeal or amend any portion of said rules, regulations and schedules.
Any person, firm or corporation who or which violates or neglects to comply with any provision of this article or any regulation promulgated pursuant thereto shall, upon conviction thereof, be punishable by a fine of not less than $50 or more than $500.

A. 
Severability: Each section, subsection, sentence, clause and phrase of this article is declared to be an independent section, subsection, sentence, clause and phrase, and the finding or holding of any such portion of this article to be unconstitutional, void, or ineffective for any cause, or reason, shall not affect any other portion of this article.
B. 
Repealer: All other ordinances of the Borough, or parts thereof, which are in conflict with this article are hereby repealed to the extent of such conflict.
C. 
Effective date: This article shall be in full force and effect from and after its adoption and any publication as may be required by law.
