The purpose of this zone district is to provide certain development bonuses in settlement of a Mount Laurel action entitled "Jomac Realty, Inc., et al. v. Borough of Allendale" and in consideration of the developer’s agreement to contribute to the production of lower-income housing in partial satisfaction of Allendale’s affordable housing obligation under N.J.S.A. 52:27D-301 et seq. and N.J.A.C. 5:93.
This zone district is intended for townhouses, as defined in § 270-8, and off-street parking incidental to the townhouse use.
Any use other than those permitted herein is prohibited.
A. 
Density. A total of 16 townhouses shall be permitted to be constructed in this zone district, of which not less than two shall be affordable to low-income households and one shall be affordable to moderate-income households in accordance with Article XXVIII, Affordable Housing Standards.
B. 
Height. No building shall exceed a maximum of 2 1/2 stories or 35 feet in height. A level used exclusively as a garage shall not be considered as a story.
C. 
Area. No lot in this zone district shall be less than two acres in area.
D. 
Front, side and rear yards. No building shall be closer than 30 feet to any abutting property line.
E. 
Buffer strip. There shall be a buffer strip of at least 10 feet, located within the townhouse property, between this zone district and any property used or zoned for residential purposes, except that on the eastern boundary of this zone district, the buffer strip shall be at least five feet. This strip shall be landscaped and planted with evergreens at least six feet in height throughout its entire length and shall be so maintained. This planting shall be so located with sufficient density as to screen from view any building located on said plot from any contiguous residential zone district and shall be subject to the approval of the Planning Board. Any existing growth in such buffer strip shall be preserved if such existing growth supplements the desired screening effect. The buffer strip area may be crossed by driveways and access roadways. The buffer strip may be coincidental with and include any other setback requirements.
F. 
Occupancy of land. Not more than 50% of the land area lot may be occupied by buildings and paved areas combined, subject to any existing easement rights to the contrary.
G. 
Minimum floor area. No townhouse shall be constructed unless it shall contain a minimum living area, exclusive of porches, breezeways and garages, as follows:
(1) 
One-bedroom: 650 square feet.
(2) 
Two-bedroom: 900 square feet.
(3) 
Three-bedroom: 1,000 square feet.
H. 
Combined townhouses. Townhouses may be combined into one building, provided that the overall building shall:
(1) 
Contain not more than nine townhouses.
(2) 
Not exceed a length of 220 feet.
(3) 
Provide at least one staggered front-wall building offset of at least five feet when more than three townhouses are combined in one building.
(4) 
Provide two means of ingress and egress into each townhouse.
(5) 
Have not fewer than two walls with window exposure for each townhouse.
I. 
Landscaping. Attractive landscape plantings shall be provided and maintained, and existing trees shall be retained wherever possible.
J. 
Roadways. The right-of-way and pavement widths of all internal roads shall be adequate in size and location to accommodate the maximum anticipated traffic and access of fire-fighting and police vehicles. Minimum paved width shall be 15 feet for a one-way road and 24 feet for a two-way road. All roads shall be constructed in accordance with Borough ordinances and the laws of the State of New Jersey. Parking is prohibited on any street in this zone district.
K. 
Garages. There shall be at least one enclosed one-car garage for each market-rate townhouse as an integral part thereof.
L. 
Off-street parking. One additional off-street parking space shall be provided for each market-rate townhouse. An area of nine feet by 18 feet shall be the minimum provided for each parking space required. Two off-street parking spaces shall be provided for each affordable townhouse.
M. 
Lighting. All exterior lighting shall be arranged so as to reflect the light away from all adjoining premises.
N. 
Accessory buildings. Any building used for other than residential purposes shall be constructed at least 30 feet from any abutting property line.
Prior to the issuance of any construction permit, the Planning Board shall review and approve a site plan for the entire project in accordance with the provisions of the Land Subdivision and Site Plan Ordinance of the Borough of Allendale.[1]
