A separate and independent building sewer shall be provided for every building except where one building stands at the rear of another on an interior lot and no private sewer is available or can be constructed to the rear building. Upon approval from the village, the sewer from the front building may be extended to the rear building, provided that the hydraulic capacity of the existing sewer is not exceeded. The condition of the existing sewer shall be included as part of the application for a permit. The cost for ascertaining the condition of the existing building sewer shall be borne by the owner.

Old building sewers may be used in connection with new buildings only when they are determined by the village to meet all requirements of this Part 1. The condition of old sewers shall be determined prior to applying for a permit and shall be included as part of the application. The costs for inspection, testing and examination necessary to make this determination shall be borne by the owner.

Whenever possible, the building sewer shall be brought to the building at an elevation below the basement floor. For buildings with a basement floor drain too low to permit gravity flow of wastewater to the public sewer, the wastewater shall be lifted and discharged to the building sewer in a manner approved by the village.

All new sewers, sewer extensions, building sewers and appurtenances tributary to the village POTW shall be properly designed, constructed and tested in accordance with the most recent edition of the following documents: Recommended Standards for Sewage Works, Great Lakes Upper Mississippi River Board of State Sanitary Engineers; specifications as set forth by the American Society for Testing and Materials; practice as set forth by the Water Pollution Control Federation Manual of Practice No. 9; and rules, regulations and policy as set forth by the New York State Department of Environmental Conservation and United States Environmental Protection Agency. An exception to these standards as set forth is the allowable leakage requirement for village sewers. The maximum permissible leakage for all new sanitary sewers, sanitary sewer extensions, appurtenances and building sewers being made part of or tributary to the village POTW, whether determined by infiltration or exfiltration testing, shall be at the rate of 100 gallons per inch of internal diameter of sewer per mile per 24 hours.

After the effective date of this Part 1, the construction and use of new combined sewers or extensions to existing combined sewers tributary to the village service area shall be prohibited.

A. 

The size, slope, alignment, materials of construction of a building sewer and the methods to be used in excavating, placing of the pipe, jointing, testing and backfilling the trench shall be included as part of the plans and specifications to be submitted for approval. These methods shall conform to the requirements of the appropriate Building and Plumbing Codes

or other applicable rules and regulations of the Village of Blasdell. In the absence of code provisions or in amplification thereof, the materials and procedures set forth in appropriate specifications of the American Society for Testing and Materials and Water Pollution Control Federation Manual of Practice No. 9 shall apply.

B. 

Plans and specifications for sanitary sewers and appurtenances shall be approved in writing by the village before the start of construction. Construction shall be in accordance with such approved plans and specifications. Results of leakage test shall be submitted to the village prior to placing the sewer in operation.

The connection of the building sewer into the public sewer shall conform to the requirements of the Building and Plumbing Codes

or other applicable rules and regulations of the village or the procedures set forth in the Water Pollution Control Federation Manual of Practice No. 9. Materials used to make the building connection shall conform to the appropriate current specifications of the American Society for Testing and Materials. All such connections shall be made gastight and watertight. Any deviation from the prescribed procedures and materials must be approved by the village before installation. Connection details shall be included as part of the plans and specifications submitted for approval.

A. 

The applicant for the building sewer permit shall notify the village at least 24 hours prior to the time when the building sewer is ready for inspection and connection to the public sewer. The connection shall be made under the supervision of the village.

B. 

All costs and expenses incident to the installation and connection of building sewers shall be borne by the owner. The owner shall indemnify the village from any loss or damage that may directly or indirectly be occasioned by the installation of the sewer.

As a minimum, all excavations for building sewer installations shall conform to the latest requirements of the United States Department of Labor, Occupational Safety and Health Administration (OSHA) and shall be adequately guarded with barricades and lights so as to protect the public from hazard. Alternate traffic patterns shall be provided and maintained around streets, sidewalks, parkways and other public property disturbed as a result of the work. All areas which are disturbed because of the sewer construction work shall be restored to the conditions which existed prior to the start of construction, as well as to the satisfaction of the village.

No person shall uncover, make any connections with or opening into, use, alter or disturb any public sewer or appurtenance thereof without first obtaining a written permit from the village as described in this Article, § 198-17. No work performed in conjunction with sewer tap-ins shall in any way impair, restrict or alter the flow in the existing sewer system.

The Village Board shall not issue a permit for any class of connection to the village's POTW unless there is sufficient capacity, not legally committed to other users, in the POTW to convey and adequately treat the quantity of wastewater which the requested connection will add to the system. The Village Board may permit such a connection if there are legally binding commitments to provide the needed capacity.

No downspout, leader, gutter or pipe, drain or channel which may at any time carry cooling water, stormwater, surface water, groundwater or unpolluted water of any kind, nor any drain from any catch basin, lake, swamp, pond or swimming pool, nor any inlet for cooling water, surface water, stormwater, groundwater or unpolluted water of any kind, shall be connected to the village POTW.

A. 

After the effective date of this Part 1, all persons wishing to connect to the village POTW must secure a connection permit from the Village Board prior to starting construction. All persons applying for a permit to connect to the village POTW shall file with the Village Board an application as a prerequisite for the consideration of such a permit.

B. 

There shall be three classes of connection permits:

(1) 

For residential service.

(2) 

For commercial service.

(3) 

For service to establishments producing industrial wastes.

C. 

In any case, the owner or his agent shall make application on a standard permit application form. The application(s) may be supplemented by plans and specifications as well as other information considered pertinent by the village.

A. 

The following permit fees shall be paid to the village for sewer use at the time the application is filed:

(1) 

For each single-family building: as set by the Board of Trustees.

(2) 

For each multifamily building with two or more residential units: as set by the Board of Trustees.

(3) 

For each commercial building: as set by the Board of Trustees.

(4) 

For each combined residential/commercial building, the above fees shall be added for each separate use and the sum shall be the total fee.

(5) 

For each residential building combined with customary home occupation or professional office: as set by the Board of Trustees.

(6) 

For each industrial building: as set by the Board of Trustees, plus all direct costs incurred by the village for evaluating the application information required by this Part 1 and determining the impact of the proposed wastewaters on the POTW. Costs shall include but not be limited to: laboratory analysis fees, consulting engineering fees, treatability studies, etc. If more than one business is located within an industrial building, each user shall pay a fee as set by the Board of Trustees, plus its share of all other related costs set forth herein. All industrial users shall be continuously monitored by the village, and the industrial user, as a condition to the issuance of a permit, shall consent to such monitoring, shall consent to give the village access to its facility at all reasonable hours and during emergency situations and shall consent to promptly giving the village all information and data which the village deems to be necessary to conduct such monitoring. The actual cost of such monitoring shall be added to the industrial user's annual sewer charge and shall be deemed to be part of such charge.

B. 

A tapping fee as set by the Board of Trustees shall be paid by all persons wishing to connect to the POTW. The tapping fee shall be paid to the village upon approval of the application and issuance of a permit.

C. 

All moneys received from permit fees and/or tapping fees shall be placed in a special sewer reserve fund for the sole purpose of funding capital improvements to the Blasdell wastewater treatment facilities. These moneys may not be used for operation and maintenance of the Blasdell wastewater treatment facilities.

The following terms may be imposed by the village in the issuance of a permit:

A. 

The submission to and approval by the village of plans and specifications for any of the facilities or equipment required to be installed and maintained by the permittee.

B. 

Revocation or suspension of the permit upon violation by the permittee.

C. 

The requirement that any person conducting the trade or business calling for a plumber or related to plumbing obtain a certificate of competency from the village. Such a certificate shall be issued upon the determination by the village that the applicant, in fact, is a journeyman plumber.

D. 

The requirement that all plumbing and/or plumbing work required by this Part 1 and the Building and Plumbing Codes

of the Village of Blasdell or such codes as may pertain to the village POTW shall be performed by a journeyman plumber or under the direct supervision and control of such journeyman plumber.

E. 

Such other terms and conditions as may be deemed necessary by the Village Board to carry out the intent and provisions of this Part 1.
