There is hereby created a special parking designation on City streets to be known as "handicapped reserve parking."

Any person who has a physical disability which is permanent in nature or which will last for at least two years, which significantly impairs that person's ability to walk safely to and from the residence he/she owns or to a renter, provided that he/she presents a copy of his/her current lease which is valid for one year or more, may apply to the City Clerk for a handicapped reserve parking permit for the vehicle he/she owns.
All applications shall be accompanied by a statement from one or more physicians describing, in detail, the applicant's disability, forecasting its duration and recommending that a handicapped reserve parking permit be issued. All applications shall be accompanied by a photograph of the proposed handicapped reserve parking space and a description of the same setting forth its projected dimensions. Additional information may be requested as deemed necessary by the City Clerk.
Notice of the handicapped reserve parking application shall, at the applicant's expense, be once published in a newspaper of general circulation. The notice shall set forth the location, by street and the projected dimensions of the requested handicapped reserve parking space. The notice shall also set a time and place for public consideration of the application by the City Clerk. Public consideration of any handicapped reserve parking application shall not occur within seven days from the date of published notice.
Upon approval by the City Clerk, a special permit shall be issued designating a handicapped reserve parking space for the applicant, who shall pay a fee of $5 for such permit. This fee shall be waived for any applicant who was disabled while in active service with any branch of the United States Armed Forces.
Any applicant whose application for a handicapped reserve parking space is disapproved by the City Clerk may, within 30 days, appeal such disapproval to the City Council. Notice of the appeal shall be set forth as required by § 210-65 herein.
Anyone issued a handicapped reserve parking permit shall be required to pay for the cost of a special sign, including the erection thereof, marking the handicapped reserve parking space. Use of the handicapped reserve parking space cannot begin until all costs have been paid. Handicapped reserve parking permits shall be displayed at all times in the vehicle authorized to utilize the handicapped reserve parking space. Handicapped reserve parking permits may be transferred to another vehicle only upon securing the written consent of the City Clerk. Handicapped reserve parking permits shall be issued explicitly subject to the holder's continuing compliance with all existing parking and traffic ordinances and regulations of the City.
The City Clerk may waive an applicant's payment of any fee or cost required herein upon a satisfactory demonstration that the payment of such fee or cost would cause the applicant to suffer financial hardship.
If the need for a handicapped reserve parking space ceases to exist, either by reason of death, recovery, change of applicant's residence or for any other reason, the City Clerk shall be notified immediately, the handicapped reserve parking permit shall become void, and the sign shall be removed.
A. 
Any person who obtains or attempts to obtain a handicapped reserve parking permit under false pretenses or who fraudulently utilizes a handicapped reserve parking permit shall, upon conviction, be subject to a fine of not more than $300 or to imprisonment for not more than 90 days, or both.
B. 
Any person who unauthorizedly parks any vehicle or who allows the same to remain parked in a handicapped reserve parking space shall, upon conviction, be subject to a fine of $15 and costs.
