Following receipt of conditional approval by the Planning Board of the preliminary plat and prior to approval of the final subdivision plat in accordance with these regulations, the owner shall cause to be completed certain physical improvements within the proposed subdivision at his/her own expense or, in lieu thereof, post a performance bond with the submission of the application for approval of the final subdivision plat in accordance with these regulations. The final determination as to the need of any of the physical improvements listed in §
178-18 within a residential subdivision shall be the prerogative of the Planning Board with the advice of the Engineer. When such needs have been determined as essential, this article applies. For nonresidential subdivisions, physical improvements shall be as determined by the Planning Board with the advice of the Engineer in accordance with Article
VII. Modifications of this chapter may be made by the Planning Board in accordance with Article
VIII.
