[Adopted 8-13-2001 by L.L. No. 2-2001]
A.
The Village reserves the right, in periods of drought or emergency or when deemed essential to the protection of the public health, safety and welfare, to restrict, curtail or prohibit the use of water for secondary purposes, such as sprinkling, car washing or filling swimming pools. In addition, the Village shall have the right to fix the hours and periods when water may be used for such purposes.
B.
The Village reserves the right to limit the amount of water furnished to any consumer should circumstances warrant such action, without prior agreement, or may discontinue or interrupt water used for secondary purposes, should it become necessary after rendering reasonable notice to the consumer.
C.
Interruptions in services caused by emergencies will occur from time to time. Prior notification of such interruptions will be attempted but will not be required of the Village, and the right is reserved by the Village to repair mains as needed.
D.
There are two types of water restrictions: voluntary water conservation and mandatory water conservation. Depending on the severity of the emergency, the Village Board in conjunction with the Superintendent of Public Works will determine what type of restriction to implement.
When it is decided that drought or emergency conditions are of moderate concern to the water system, Village water customers will be asked to voluntarily limit the use of water for secondary purposes, such as lawn sprinkling, car washing or filling swimming pools.
A.
When it is decided that drought or emergency conditions are of significant concern to the water system, Village water customers will be required to limit the use of water for secondary purposes, including lawn sprinkling, car washing or filling swimming pools.
B.
The mandatory water restriction will be announced to the public via publishing in the official newspaper, announcement over local radio stations and posting of a notice in nine conspicuous public locations.
C.
The Village will enforce the mandatory water restriction with Village Department of Public Works personnel. First-time violators will be issued a written notice that they are out of compliance with the mandatory water restriction and will be asked to comply. Repeat violators will be issued a citation with potential fines of up to $250 per incident. Continued violations could justify the Village to possibly consider the discontinuance or interruption of water service to the customer in violation.
