[Adopted 7-26-1988 by L.L. No. 1-1988]
[Amended 7-14-1997]
A.
The Commissioner of the Department of Public Works shall, quarterly, bring before the Board all delinquent accounts. Delinquency shall be defined as all accounts unpaid for a period in excess of 30 days from the due date of the user fee or bill.
B.
The Board shall then direct the Attorney for the Village to send out correspondence advising the user that he or she must pay the outstanding bill within 30 days of the date of the notice or, in the alternative, personally appear before the regularly scheduled Village Board meeting prior to the lapse of the 30 days and seek an extension of the time period.
C.
Failure to pay or appear and obtain an extension will result in automatic termination of the service by the Commissioner of the Department of Public Works after the lapse of the 30 days or any Board-granted extension thereof.
The passage of 30 days from due date of any water or sewer bill shall be deemed to be actual notice to the water or sewer user of the intent of the Village of Ballston Spa to terminate such service for nonpayment.
A.
Upon the payment of all outstanding water and/or sewer bills, the cost of disconnecting service and the reasonable cost of restoring such service, the Village of Ballston Spa may, in its unbridled discretion, restore water and/or sewer service to any user who has been terminated pursuant to § 200-50 above.
B.
Nothing contained herein shall require the Village of Ballston Spa to restore water and/or sewer service to any user whose service was terminated pursuant to the terms hereof.
The owner of record of the premises served by such water and/or sewer service as shown on the records of the Department of Public Works of the Village of Ballston Spa shall be deemed to have consented to the termination of such service by his/her or its failure to pay any water or service bill within 30 days of the due date thereof.
The Village of Ballston Spa is not required to restore water and/or sewer service to any premises to which such service has been terminated for nonpayment of water or sewer user fees.
