The position of Borough Administrator is hereby created, and employment of a qualified person for that position is hereby authorized.
The Borough Administrator shall be appointed pursuant to the provisions of N.J.S.A. 40:87-16.[1]

A. 
The Borough Administrator may be suspended without pay by the Mayor and Council at any time pending a hearing. He may be removed from office by the Mayor and Council for just cause, upon 30 days' written notice, after adoption of a resolution setting forth the reasons for removal. Such resolution shall be adopted by a two-thirds vote of the Borough Council.
B. 
The Borough Administrator, upon receipt of a resolution of removal properly approved. may reply within 10 days of receipt and request a public hearing. A public hearing, if any, shall be held not earlier than 15 days nor later than 30 days after the request is received by the Borough Council. The findings of the hearing and decision of removal shall be by written resolution approved by a two-thirds vote of the Borough Council.
C. 
If the Borough Administrator is restored to his position, he shall be entitled to any compensation lost by reason of his suspension.

A. 
The Borough Administrator shall be appointed on the basis of administrative qualifications, with special regard to education and training in governmental affairs and experience therein.
B. 
No elected member of the governing body may receive such appointment unless he first resigns his office. If a member of the governing body resigns his office in order to be appointed to the position of Borough Administrator, the salary of the Borough Administrator shall not be increased during the term of office of the governing body member so resigning.
The Borough Administrator shall be a resident of the Borough. In the event that on the date of the initial appointment he is not a resident, he shall become one within one year of such appointment and shall continue his residency throughout his term of office. If circumstances so warrant, this residency requirement may be waived by a majority vote of the Borough Council.
During any approved absence or disability of the Borough Administrator, an officer or employee of the Borough may be appointed by the Borough Council to temporarily perform the duties and responsibilities of the position.
The compensation of the Borough Administrator shall be fixed by the Borough Council by appropriate ordinance.

The Borough Administrator shall act as the chief administrative officer of the Borough. His duties shall include, with the advice and consent of the Mayor and Council and under their direction, the development of rules and regulations for administrative procedures governing purchasing practices, operation of all departments, personnel management and general coordination of departments, offices, boards and agencies of the Borough, all for the purpose of increasing the effectiveness and efficiency of the Borough government and promoting its economic operation. The Borough Administrator shall perform the duties hereinafter enumerated and such other duties as may be assigned to him by the Mayor with the consent of the Borough Council:
A. 
He shall act as the Administrator for the Mayor and the Council of the Borough and, as such, will supervise all salaried personnel of the Borough through the respective department heads unless otherwise provided for by law or by this chapter. He shall devote his entire time and effort to the performance of his duties and functions. He shall not engage in any other occupation or employment while employed by the Borough except as assigned by the Mayor and Council.
B. 
He shall integrate and coordinate the functions of all departments, boards, agencies, offices, officials and employees of the Borough and shall maintain liaison with the Boards of Education of Florham Park and Hanover Park Regional High School, authorities and commissions.
C. 
He shall supervise the purchase of all materials, equipment and supplies authorized by the Borough Council; establish standards and specifications to control all purchases by the Borough and recommend to the Council such standards as to quality, size and variety of articles, equipment and supplies used by the offices and departments of the Borough to make possible uniform purchasing practices; advertise for proposals for the furnishing of any and all work required to be done for the Borough; receive bids therefor at the direction of the Borough Council; receive all department requisitions for all materials, equipment and supplies approved for purchase by committee Chairmen; act as the purchasing agent in the purchase of such materials, equipment and supplies; issue the necessary purchase order to the lowest responsible bidder for such materials, equipment and supplies for all departments; require that all departments, including police and fire, secure a purchase order prior to the purchasing of all services, supplies, materials or equipment approved in the budget; ensure that all purchases are at a most favorable price to the Borough; and see to it that the materials, equipment, services or supplies delivered are correct in number or amount and comply with the standards and specifications prescribed by the governing body as agreed to at the time of purchase. Pursuant to N.J.S.A. 40A:11-9, the Administrator, as purchasing agent, is authorized to award contracts for the purchase of goods and services in amounts up to the bid threshold pursuant to N.J.S.A. 40A:11-3, as amended from time to time. The Administrator shall supervise the qualified purchasing agent who, pursuant to N.J.S.A. 40A:11-9b, is authorized to award contracts for the purchase of goods and services in amounts up to the bid threshold pursuant to N.J.S.A. 40A:11-3, as amended from time to time.

D. 
He shall collect all data and prepare a proposed budget for consideration by the Mayor and Council, annually, on or before December 15 of each year, after obtaining requests for appropriations from all departments of the Borough and consulting with all department heads. The proposed budget shall be accompanied by the proper supplemental detail in support of the proposed budget appropriation with a comparison of prior year's expenditure and an analysis of the proposed expenditures with recommendations regarding the feasibility thereof. Upon adoption of the budget, current accounts of the expenditures made shall be kept on a monthly basis based upon the supplemental detail of the adopted budget.
E. 
He shall require the various departments of the Borough to furnish annually an adequate inventory of all equipment. materials and supplies in stock and recommend the sale of any surplus. obsolete equipment, materials and supplies.
F. 
He shall prepare and have custody of all municipal records not required by law to be kept by another officer of the Borough and establish and keep up-to-date a coordinated filing system for all Borough departments, offices, boards and agencies.
G. 
He shall keep the Mayor and Council currently informed on all matters within his jurisdiction by submitting such reports as he deems advisable or as requested by the Mayor and Council and prepare and present to the Mayor and Council an annual report on Borough matters and make such other reports as from time to time the Mayor and Council may require.
H. 
He shall advise the Mayor and Borough Council on all matters of administration, organization and personnel and assign office personnel to the performance of various duties in various departments and study, recommend, implement and enforce personnel organization and policy of the Borough and implement vacation policy as established by the Borough Council for all departments, except as otherwise provided by statute for Police and Fire Departments.
I. 
He shall study, recommend, implement and enforce procedures and policy of the Borough and its departments for receipt, dissemination and collation of and responses to communications and requests for information after consultation with department heads and receive, distribute and follow up requests for information and complaints from citizens and keep the Mayor and Council informed on such matters.
J. 
He shall prepare an agenda fur and arrange meetings and conferences of the Mayor and Council and other agencies of the Borough, when so requested by the Mayor and Council.
K. 
He shall attend all meetings of the Mayor and Council, unless excused by that body.
Nothing in this chapter shall derogate from or authorize the Borough Administrator to exercise the powers and duties of elected officials of the Borough and of the boards and agencies thereof established pursuant to law.
