As used in this chapter, the following terms shall have the meanings indicated:
INSTANT RAFFLE GAMES
Includes all instant raffle games and other similar lawful games of chance for use by qualified organizations, which includes charitable, educational, fraternal, civic and religious organizations, volunteer fire companies, rescue squads and senior citizen associations which have first been registered with the Legalized Games of Chance Control Commission of the State of New Jersey ("Control Commission").
PERSON
Includes individuals, partnerships, voluntary associations and corporations.
No person shall conduct an instant raffle game within the Borough unless such person first shall have obtained a license for such purpose from the Mayor and Borough Council.
A. 
The Mayor and Borough Council may, after application in an acceptable manner and form, grant a license to hold an instant raffle game for a term not exceeding one year from the date of the issuance of such license. Application forms may be obtained from the office of the Borough Clerk. Applications must be submitted at least 60 days in advance of the scheduled instant raffle game. The information required to be provided on an application includes:
(1) 
The type of activity to be licensed.
(2) 
The dates and hours during which the game(s) will be conducted.
(3) 
The address where the game(s) will be conducted.
(4) 
A schedule of expenses to be incurred in connection with the game(s).
(5) 
The purpose(s) for which the net game proceeds will be used.
(6) 
A description of the prizes to be offered.
(7) 
A sworn statement by the organization's member in charge that the game(s) will be conducted in accordance with the relevant gaming laws and that the proceeds will be used for the authorized purposes, as described in the application.
B. 
The application must be filed in quadruplicate with the Borough Clerk. One copy will be retained by the Borough, the second will be returned to the applicant after a license is issued or denied by the Borough, the third will be forwarded to the Control Commission, and the fourth will be filed with the Borough Police Department. No application for a license shall be considered unless the applicant shall have first registered with and received an identification number from the Control Commission.
The following fees must be paid to the Borough Clerk before the issuance of any license under this chapter:
A. 
A fee payable to the Borough of Florham Park in the amount of:
(1) 
Twenty dollars for each day on which the instant raffle game tickets are sold or offered for sale (for one-time events); or

(2) 
Fifty dollars for a one-year license to sell or to offer for sale, on an unlimited basis, instant raffle game tickets during the licensing year (for weekly raffles conducted during the course of a year).
B. 
A fee payable to the Control Commission in the amount of:
(1) 
Twenty dollars for each day on which the instant raffle game tickets are sold or offered for sale (for one-time events); or

(2) 
Five hundred dollars for a one-year license to sell or to offer for sale, on an unlimited basis, instant raffle game tickets during the licensing year (for weekly raffles conducted during the course of a year).
The Mayor and Borough Council shall have the right to revoke any license issued for any violation of this chapter or for the violation of any ordinance of the Borough.

The authority set forth in this chapter of the governing body to approve the granting of raffle licenses within the Borough of Florham Park is hereby delegated to the Borough Clerk.

Pursuant to N.J.S.A. 5:8-58, raffles may be operated on Sundays within the Borough at public events.
Any person violating a provision of this chapter by operating an instant raffle game encompassed by this chapter without a license shall be punished as set forth in Chapter 1, § 1-16 of the Code of the Borough of Florham Park.
