For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:
DEPARTMENT
The Water Department of the Borough.
FRANCHISE AREA
Those areas in the northwesterly area of the Borough along Park Avenue and in the southeasterly area of the Borough along Passaic Avenue to be serviced by New Jersey American Water Company as established by Borough Ordinance No. 2-90.[1]
HOUSE CONNECTION
The line construction from the curb stop or valve to the point where such line joins the meter.
MAIN
The transmission and distribution pipeline and appurtenances owned by the Borough and located in a public street, right-of-way or easement.
MAINS IN PRIVATE PROPERTY
Privately constructed water mains and services which are turned over to and accepted by the Borough to become part of the Borough water systems, together with a permanent right-of-way or public easement so that the Borough may enter upon to excavate, maintain and service the main.
SERVICE AGREEMENT
Contract pursuant to the County and Municipal Water Supply Act, N.J.S.A. 40A:31-1 et seq.
SERVICE LINE
The line from the Borough main to the curb or to the limit of the right-of-way, including the curb stop or valve at the end of such line.
SUPPLIER
Any entity, exclusive of the Borough Water Department, supplying water to consumers within the Borough.
WATER OPERATIONS COMPANY
A private company with which the Borough has entered into a contract with pursuant to the County and Municipal Water Supply Act, N.J.S.A. 40A:31-1 et seq., for the purposes of operation and maintenance of the Borough water supply system. The Borough retains full ownership of the water system.

No person shall at any time obstruct or prevent free access to any meter, main, service line, house connection, curb stop, curb box, valve, hydrant or other fixture by any authorized employee of the Water Department or water operations company for the purpose of reading, testing, repairing or inspecting such meter, main, service line or house connections.
No person other than members of the Fire Department, Water Department, Public Works Department or water operations company shall be permitted to open any fire hydrant. Only standard hydrant wrenches shall be used in opening and closing of fire hydrants.
A. 
The Water Department and/or water operations company will test and maintain all Borough-owned hydrants annually. The Water Department and/or the water operations company in accordance with the then existing contract shall test privately owned hydrants for an annual fee as set forth in § 244-41J. Where privately owned hydrants must be replaced, the Water Department and/or the water operations company may do this at the owner's expense if it is provided for in a then existing service agreement.
B. 
Water hydrants in the franchise areas will be tested and maintained by the franchisee.
All work done by or under the provisions of this chapter shall comply with all rules and regulations of the Department of Environmental Protection and the provisions of the County and Municipal Water Supply Act, N.J.S.A. 40A:31-1 et seq. as well as the ordinances of the Board of Health of the Borough, and shall be performed under the supervision of the Public Works Department and/or the water operations company.
A. 
It shall be the duty of all Borough employees to report any violations of this chapter to the Director of Public Works or Water Superintendent. The Director of Public Works shall report to the Mayor and Council all violations of this chapter and of the rules and regulations of the Water Department which come to his knowledge or attention and the action taken.
B. 
To the extent that the terms of this Chapter 244 are to be applied in the franchise area, the supplier shall cooperate with the Water Department; and the supplier shall also be empowered to enforce all applicable provisions of this chapter.
