Except as otherwise specifically provided in this chapter, the parking of any vehicles, commercial or noncommercial, owned by residents or nonresidents of the Borough of Oradell is hereby limited to a maximum period of three hours, and no parking shall be permitted in any municipal parking lot between the hours of 2:00 a.m. and 6:00 am.
The Police Department is hereby authorized to have lines or markings painted in the municipal parking lots for the purpose of designating the parking space to be used by each parked vehicle.
Each vehicle parked in a municipal parking lot shall be parked only within the lines or markings designating parking spaces as provided in § 165-2. It shall be unlawful for any person to park any vehicle across any such line or marking or to park the vehicle in such position that the same shall not be entirely within the area so designated by such lines or markings.
A. 
In each municipal parking lot serving a building or buildings in the Borough of Oradell, there shall be a minimum of 1% of the total number of parking spaces, but not less than two parking spaces, for use by persons who have been issued special vehicle identification cards by the Division of Motor Vehicles, said parking spaces to be located in an area of the parking lot which is nearest to the building or facility which the parking lot serves.
B. 
Parking spaces for the handicapped shall be identified with a clearly visible sign mounted off the ground and displaying the symbol for the handicapped pursuant to the Manual on Uniform Traffic Control Devices for Streets and Highways and containing appropriate wording, e.g., "reserved parking."
C. 
Private property.

(1) 
The purpose of this subsection is to establish certain areas that are private property that are open to the public or in which the public is invited in which parking in areas designated as handicapped parking spaces shall be prohibited except by those persons who have been issued special identification cards by the Division of Motor Vehicles.
(2) 
This subsection is enacted in accordance with N.J.S.A. 40:48-2.46, which does confer upon the Borough of Oradell the right to establish handicapped parking spaces in order to preserve and safeguard the public health, safety, morals and welfare.
(3) 
Parking spaces on either public or private property which are designated as handicapped parking spaces shall be for the sole use by persons who have been issued special identification cards by the Division of Motor Vehicles. No other person shall be permitted to park in these spaces, and said spaces shall be so marked by signs indicating "HANDICAPPED PARKING SPACES."

(4) 
For violation of any provision of this subsection, an individual shall be liable to a fine of $250 for the first offense and a fine of $250 plus a maximum of 90 days' community service for all subsequent offenses.

The following types of parking permits may be issued for noncommercial vehicles only:
A. 
Resident permit to be issued only to residents of the Borough of Oradell.
B. 
Nonresident employee permit: to be issued only to nonresident person employed or operating a business as proprietor or partner in the Borough of Oradell, except employees or operators of businesses in those areas of the Borough zoned for general office buildings where parking is provided by the owner of the general office building.

D. 
Overnight parking permit: to be issued only to residents of the Borough of Oradell with the specific approval of the Chief of Police.
E. 
Borough employee permit: to be issued only to resident or nonresident employees or elected officials of the Borough of Oradell.
Application for all parking permits shall be made at police headquarters upon forms supplied by the Police Department. The applicant shall exhibit the registration for the vehicle for which the permit is to be issued and any other documentation which may be reasonably requested to establish that the applicant qualifies for the permit applied for, including but not limited to evidence of employment in the of a nonresident employee permit. Upon approval of the application and receipt of the application fee, if any, the Police Department shall issue a form or permit which shall be affixed to the motor vehicle of the applicant in such a manner as provided by the rules and regulations of the Police Department.

Any parking permit issued pursuant to this chapter shall expire at midnight on December 31 of the year in which it is issued, except that permits issued to residents of the Borough of Oradell pursuant to § 165-5A shall continue in effect indefinitely as long as the holder thereof is a resident of the Borough of Oradell. Furthermore, overnight permits are renewable on an annual basis.
A parking permit issued pursuant to this chapter constitutes a license to park the vehicle for which it was issued and to which it is affixed, in parking spaces in municipal parking lots designed for the parking of vehicles having such permit, it does not represent a guaranty or assurance of available space.
A. 
It shall be the responsibility of the holder of a parking permit to remove it from the vehicle and, regardless of condition, surrender it to the Police Department, when the conditions under which the permit was issued no longer exist. Failure to do so will be a violation of this chapter.
B. 
Replacements may be issued upon the return of the existing permit, regardless of its condition. Permits may be used only for the vehicle for which it is issued. Any substitution will be a violation of this chapter.
C. 
In the case of nonresident employee permits, in the event that the holder no longer qualifies for such permit due to termination of employment or other cause, it shall be the responsibility of the employer to cause the surrender of such permit as a condition to the issuance of a replacement.
A. 
Veldran Avenue Municipal Parking Lot, being the lot lying east of Kinderkamack Road north of Veldran Avenue and west of the railroad right-of-way. It shall be unlawful to park any vehicle for a period exceeding three hours between the hours of 6:00 a.m. and 2:00 a.m. unless such vehicle bears a valid resident permit, nonresident employee permit or nonresident commuter permit, except that parking in the first seven parking spaces at the southeast corner of said lot shall be limited to 15 minutes. It shall be unlawful to use this lot or any part thereof as a thoroughfare between Kinderkamack Road and Veldran Avenue either way. Signs specifying "no through traffic" shall be posted at each entrance.

B. 
Schirra Park Municipal Parking Lot, being the lot between Oradell Avenue and Veldran Avenue, east of Schirra Park. It shall be unlawful to park any vehicle, with or without a parking permit, for a period exceeding one hour between the hours of 8:00 a.m. and 6:30 p.m., and between the hours of 6:30 p.m. and 8:00 a.m., it shall be unlawful to park any vehicle unless it bears a valid overnight parking permit.
C. 
World War I Memorial Municipal Parking Lot, being the lot north of Oradell Avenue east of the railroad right-of-way. It shall be unlawful to park any vehicle for a period exceeding three hours between the hours of 6:00 a.m. and 2:00 a.m. unless such vehicle bears a valid resident permit.
D. 
Library Municipal Parking Lot, being the lot between Oradell Avenue and Church Street west of the Oradell Public Library, consisting of: the upper lot, being the westerly half thereof; and the lower lot, being the easterly half thereof.

(1) 
In the upper lot, it shall be unlawful to park any vehicle for a period exceeding three hours between the hours of 6:00 a.m. and 2:00 a.m. unless such vehicle bears a valid resident employee permit and except for 10 parking spaces to be designated by the Chief of Police, in the west side of said lot, to be reserved for parking for employees of the Oradell Public Schools.

(2) 
In the lower lot, east side, it shall be unlawful to park any vehicle between the hours of 6:00 a.m. and 2:00 a.m., with or without a parking permit, for a period exceeding one hour, except for up to six parking spaces to be designated by the Chief of Police, to be reserved for parking for employees of the Oradell Free Public Library; in the lower lot, west side, it shall be unlawful to park any vehicle between the hours of 6:00 a.m. and 2:00 a.m. for a period exceeding three hours unless such vehicle bears a valid resident permit.

E. 
Borough Hall Municipal Parking Lot, being the lot immediately west of the Borough Hall, consisting of: the upper lot, being the westerly half thereof; and the lower lot, being the easterly half thereof.

(1) 
In the upper lot, it shall be unlawful to park any vehicle for a period exceeding three hours between the hours of 6:00 a.m. and 6:00 p.m. unless such vehicle bears a valid resident permit, nonresident employee permit or Borough employee permit, and between the hours of 2:00 a.m. and 6:00 a.m. unless it bears a valid overnight parking permit or, in the case of a commercial or noncommercial vehicle, it has been given temporary permission, for not over 48 hours, by the Chief of Police.

(2) 
In the lower lot, it shall be unlawful to park any vehicle for a period exceeding 30 minutes between the hours of 6:00 a.m. and 6:00 p.m. unless such vehicle bears a valid Borough employee permit. It shall further be unlawful to park any vehicle in said lot between the hours of 2:00 a.m. and 6:00 a.m. unless it bears a valid Borough employee permit.
(3) 
On the east side of the exit roadway, leading from the upper lot to Church Street, it shall be unlawful to park any vehicle for a period of time exceeding 30 minutes.

(4) 
In the upper lot, it shall be unlawful to park any vehicle in any of the parking spaces designated for "Police Department Use Only" during the hours of 7:00 a.m. and 3:00 p.m. There shall be up to eight parking spaces designated for "Police Department Use Only" in the upper lot.

(5) 
In the lower lot, it shall be unlawful to park any vehicle in the parking spaces designated for the Mayor, Administrator, Clerk and members of the Police Department. It shall be unlawful for anyone other than the current or acting Mayor, Administrator, Chief Financial Officer or Clerk, or a member of the Police Department, to park in any parking space designated for use by such officeholder. There shall be one parking space each designated for the Mayor, Administrator, Chief Financial Officer and Clerk, up to nine parking spaces designated for members of the Police Department and, in the north end of the upper lot next to the existing parking area for police only, 7:00 am to 4:00 p.m., 10 parking spaces for employees only, 7:00 a.m. to 4:00 p.m.

F. 
Park Avenue Municipal Parking Lot, being the lot north of Park Avenue west of Kinderkamack Road. It shall be unlawful to park any vehicle for a period exceeding three hours between the hours of 6:00 a.m. and 7:00 p.m. unless such vehicle bears a valid resident permit, nonresident employee permit or nonresident commuter permit, and between the hours of 7:00 p.m. and 6:00 a.m., it shall be unlawful to park any vehicle unless it bears a valid overnight parking permit.
G. 
Pyle Street Municipal Parking Lot, being the lot bound on the south by Lake Avenue and on the west by Pyle Street. It shall be unlawful to park any vehicle for a period exceeding three hours between the hours of 6:00 a.m. and 2:00 a.m. unless such vehicle bears a valid resident permit or nonresident employee permit, except that in the most easterly line of spaces in said lot it shall be unlawful to park any vehicle, with or without a parking permit, for a period exceeding one hour between the hours of 8:00 a.m. and 8:00 p.m. It shall further be unlawful to park any vehicle in said lot between the hours of 2:00 a.m. and 6:00 a.m. unless it bears a valid overnight parking permit.

H. 
Waite Place Municipal Parking Lot, being the lot lying east of Kinderkamack Road and north of Waite Place. It shall be unlawful to park any vehicle for a period exceeding three hours between the hours of 8:00 a.m. and 9:00 p.m. unless such vehicle bears a valid resident permit, and between the hours of 9:00 p.m. and 8:00 a.m. it shall be unlawful to park any vehicle unless it bears a valid overnight parking permit.

I. 
Meyerhoff Place Municipal Parking Lot, being the lot lying east of Meyerhoff Place between Mackay Avenue and Winne Avenue. It shall be unlawful to park any vehicle for a period exceeding three hours between the hours of 8:00 a.m. and 9:00 p.m. unless such vehicle bears a valid resident permit, or nonresident employee permit, and between the hours of 2:00 a.m. and 6:00 a.m., it shall be unlawful to park any vehicle unless such vehicle bears a valid overnight parking permit.

J. 
Ridgewood Avenue Municipal Parking Lot East, being the lot on the east side of Doug Parcells Athletic Complex on Ridgewood Avenue. It shall be unlawful to park any vehicle unless said parking is for the purpose of being a participant in or a spectator watching a sports activity.

K. 
Marginal Road Municipal Parking Lot, being the lot at the Department of Public Works. The parking spaces will, subject to availability, each be eight feet by 20 feet, or larger, and the license for the use of each shall be by written agreement and will be as follows:

(1) 
One thousand two hundred dollars per year (annual license) with payment at start of term. The term of the annual license for the use of each space shall commence on March 1 of each year and shall expire on February 28 of each ensuing year. There shall be no pro rata billing for the parking spaces under an annual license; i.e., regardless of when the license for any parking space is entered into between the Borough and a licensee, the full fee of $1,200 must be paid; or
(2) 
Four hundred dollars for three months (quarterly license) with payment at start of term. The terms of the quarterly license for the use of each space shall commence on the first day of a calendar month and shall expire on the last day of the last calendar month of the term. There shall be no pro rata billing for parking spaces under a quarterly license: i.e., regardless of when the license for any parking space is entered into between the Borough and a licensee, the full fee of $400 must be paid.
(3) 
Renewals shall be made on or before January 1 of every year. Initial rentals as well as renewal procedure will include:

(a) 
Submittal of application/renewal form.
(b) 
Proof of registration and insurance.
(c) 
Execute a hold harmless agreement and lease agreement on Borough-produced document.
(d) 
Renters will be issued a color-coded annual sticker that is to be placed according to rental agreement. Keys shall not be duplicated and spaces shall not be sublet.
L. 
It shall be unlawful to stop or park any vehicle in two parking spaces to be designated by the Chief of Police, immediately adjacent to the Oradell Train Station, which spaces shall be reserved and designated for the lessee of the Oradell Train Station.

M. 
Ridgewood Avenue Municipal Parking Lot West, being the lot on the west side of Doug Parcells Athletic Complex on Ridgewood Avenue.
(1) 
It shall be unlawful to park any vehicle for a period exceeding three hours between the hours of 6:00 a.m. and 6:00 p.m. unless:

(a) 
Said parking is for the purpose of being a participant in or a spectator watching an event at Doug Parcels Athletic Complex or visiting the Oradell Swim Club.
(b) 
Such vehicle bears a valid resident permit, nonresident employee permit, Borough employee permit, or student permit.
(2) 
There shall be no parking in this lot between the hours of 2:00 a.m. and 6:00 a.m. unless the vehicle bears a valid overnight parking permit or, in the case of a commercial or noncommercial vehicle, it has been given temporary permission by the Chief of Police.
The speed limit for vehicles in, entering or leaving any municipal parking lot in the Borough of Oradell is 15 miles per hour.
Fees for parking permits shall be as indicated in Chapter 115, Fees.
A. 
For a violation of a provision of this chapter or any supplement thereto for which no specific penalty is provided, the offender shall be liable to a penalty of not more than $50 or imprisonment for a term not to exceed 15 days, or both.
B. 
Any fraud, misrepresentation or false statement contained in any application filed pursuant to this chapter and any continued use of a permit when the conditions under which the permit was issued shall constitute a violation of this chapter.
