The provisions of the Solid Waste Disposal Standards adopted and published
as Chapters NR 180 and 181 of the Wisconsin Administrative Code are hereby
adopted and by reference made a part of this article as if fully set forth
herein.
It shall be unlawful for any person, other than the town, to establish,
maintain, conduct or operate a solid waste disposal operation in the Town
of St. Joseph.
Any person, firm or corporation who or which fails to comply with the
provisions of this article shall, upon conviction thereof, forfeit not less
than $10 nor more than $200 for each offense, together with the costs of prosecution,
and in default of payment of such forfeiture and costs of prosecution shall
be imprisoned in the county jail of St. Croix County until said forfeiture
and costs are paid, but not to exceed 30 days for each violation. Each violation
shall constitute a separate offense.
The purpose of this article is to promote, regulate and require the
separation, collection and processing of recyclable materials to the greatest
extent feasible.
This article is enacted pursuant to W.S.A. s. 287.09(3)(b). The provisions
of the St. Croix County Recycling Ordinance are adopted and made a part hereof
by reference, except as otherwise provided herein.
Owners and occupants of single-family and multifamily residences and
nonresidential facilities located within or conducting business in the Town
of St. Joseph are required to separate and/or recycle from their solid waste
those items identified in Sections 10, 11 and 12 of the St. Croix County Recycling
Ordinance.
Definitions shall include, but not be limited to, those definitions
included in the St. Croix County Recycling Ordinance.
All solid waste haulers or recyclers conducting business within the Town of St. Joseph must provide for collection of recyclable materials at least one time per month. All haulers or recyclers must register with the Town Clerk and file appropriate reports as listed in §
163-9. All haulers or recyclers must offer at least one volume-based pricing option. All haulers or recyclers must provide their customers with instructions on how to sort and package their recyclable materials. A copy of this information should be provided to the Town Clerk.
Violations of this article shall be subject to the penalties provided
in the St. Croix County Recycling Ordinance.
