Every resident (other than a dealer or rental
agency) of the Borough shall cause every bicycle in his ownership
or custody to be registered as hereinafter provided before such bicycle
is used on any street or in any public place in the Borough.
The procedure for registration shall be as follows:
A. The owner shall file with the Police Department, without
charge, a written application on a form prescribed by the Borough;
B. Upon satisfactory proof of ownership of the bicycle,
and of compliance of the bicycle with the statutory requirements relating
to lights, reflectors, signals and brakes, the Police Department shall
issue to the owner a registration card and a registration tag.
A bicycle shall be deemed registered in compliance
with this chapter if the owner has received from the Police Department
a currently valid registration card and a registration tag and has
caused the registration tag to be securely fastened to the frame of
the bicycle in a conspicuous place. Except as herein otherwise provided,
no person shall willfully remove a registration tag affixed by the
owner nor shall a tag issued for one bicycle be transferred to another.
Registration shall be valid for a term of one
year, commencing January 1 and expiring December 31. Registration
may be renewed without charge by a renewal application. Upon proof
of continued ownership of the bicycle and of compliance with the statutory
requirements relating to bicycles, the Police Department shall issue
a renewal registration card. If the original registration tag on the
bicycle shall be in good condition, no new tag need be issued on renewal.
Within five days after selling or transferring
ownership of his bicycle to a nonresident of the Borough or to a dealer,
a registrant shall surrender his registration card and registration
tag to the Police Department. Within five days after selling or transferring
ownership of his bicycle to another resident of the Borough, a registrant
shall surrender his registration card only to the Police Department,
together with the name and address of the transferee, whereupon the
Police Department shall issue a new registration card to the transferee.
The same registration tag shall remain on the bicycle.
No person engaged in the Borough in the business
of offering bicycles for hire by the public shall rent a bicycle unless
it is registered in accordance with this chapter.
Every person engaged in the Borough in the business
of buying or selling new or secondhand bicycles shall make a report
to the Police Department of every bicycle purchased or sold by such
dealer, giving the name and address of the person from whom purchased
or to whom sold, a description of such bicycle by name or make, the
frame number thereof, and the number of the registration tag, if any,
found thereon.
If a bicycle shall come into the possession
of the Police Department, by finding or recovery, and if the owner
or his whereabouts is unknown or cannot be ascertained, or if said
owner shall refuse to receive the bicycle. The Police Department shall
proceed with the disposition thereof at public auction pursuant to
public advertisement, in accordance with the statutory provisions
applicable to such disposition of personal property.
No person shall ride on any street or other
public place within the Borough any bicycle that is unregistered if
its registration is required under this chapter.
Any person who violates any provision of this
chapter shall, upon conviction thereof, be subject to a fine of not
more than $25.
