As used in this chapter, the following terms shall have the meanings indicated:
GARBAGE DEPOT or GARBAGE COLLECTION ROOM
A roofed-in enclosure in which four or more garbage cans are stored for the collection of garbage or a mechanical garbage compactor.
The owner or occupant of each and every building in the Borough shall provide a tightly covered watertight galvanized iron can or a container made of any other material or a garbage compactor approved by the Board of Health in which shall be placed all waste, animal or vegetable substance, commonly called "swill" or "garbage," from the premises of such owner or occupants. All such garbage containers shall be kept tightly covered and in an upright position. Said containers shall be constructed in such manner as to prevent the scattering of its contents by the wind and also prevent the breeding of flies and other insects. All ashes are to be kept in a separate metal container. All garbage containers shall be disinfected during the summer months.
A. 
No person other than those operating under a contract with the Borough shall engage in the business of garbage, rubbish or ash collection or other forms of scavenging, without first having obtained permission from the Mayor and Council and a permit to do so from the Board of Health.
B. 
The fee for said permit shall be $25 per year per vehicle.
C. 
Said permit shall expire on the 31st day of December of the year of issuance at 12:00 midnight.
In all apartment houses, garbage shall be removed daily by a scavenger who has received a permit from the Board of Health.
All garbage receptacles shall be removed from the curb on the day of collection, and shall be then placed or stored on the owner's premises in a place where they will not create a health hazard, create obnoxious odors, or cause an annoyance, discomfort or nuisance.
A. 
Where garbage receptacles are kept in a garbage depot or garbage collection room, said depot or room shall be well-lighted, well-drained and ventilated by a ventilator and all doors shall be self-closing. All openings shall be screened and rodent-proof. The floor shall be made of concrete.
B. 
The floor of said depot or room shall be washed daily and sanitized. The depot shall be in a state of good repair at all times.
C. 
All garbage receptacles used therein shall be washed and sanitized daily.
Any person who violates any provision of this chapter shall, upon conviction thereof, be punished by a fine not less than $2 nor more than $500. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
