There is hereby created a Cultural Commission for the City.
Said Commission shall encourage within the City of Derby participation in and promotion, development, acceptance and appreciation of artistic and cultural activities which include, but are not limited to, music, theater, dance, opera, painting, sculpture, architecture, literature, films and allied arts and crafts and to this end may join with private patrons and with institutions and professional organizations.

Said Commission shall consist of seven members, all of whom shall be appointed by the Mayor subject to approval of the Board of Aldermen, no more than four of whom shall be from the same political party. All seven members shall be appointed to serve three-year staggered terms in office. Thereafter, at the expiration of the original term of office of each of the seven members, each may be reappointed or his successor may be appointed for a term of three years, except that any vacancy shall be filled within 30 days for the unexpired portion of the term in the same manner as the original appointment or by the Board of Aldermen if the Mayor fails to act in a timely fashion.
The Chairman of this Commission is to be appointed by a vote of the majority of its members at its first meeting of each calendar year. Thereafter, the Commission shall meet at least once a month and at such other times as the Commission may determine.
A. 
The Derby Cultural Commission shall have the following financial powers and duties:
(1) 
To submit a proposed annual budget to the Board of Aldermen and the Board of Apportionment and Taxation.
(2) 
To enter into contracts within the limit of funds available, with individuals, organizations and institutions for services which will further the objectives of the Commission.
(3) 
To enter into contracts within the limits of funds available, with local, regional, state or federal associations for cooperative endeavors.
(4) 
To solicit and accept gifts, contributions and bequests of funds from individuals, foundations, corporations and other organizations for the purpose of furthering the objectives of the Commission.
(5) 
To provide a written budget report to the Board of Aldermen on the first of each month, which budget report shall include, but not be limited to, the cumulative income for the year and the income and expenditures for the previous calendar month. Said report shall be prepared in accordance with generally accepted accounting principles.

B. 
All moneys received in the manner referred to in Subsection A(4) will be placed in a separate gift account subject to an annual audit and may be expended subject to the majority approval of the Commission.
