There is hereby created a Park and Recreation Commission. Such Commission shall consist of seven members to be appointed by the Mayor subject to the approval of the Board of Aldermen, not more than five of whom shall be from the same political party. The Parks and Recreation Director and the Athletic Director of Derby High School shall serve as ex officio members without voting rights. One member of the Commission shall be appointed from the Board of Apportionment and Taxation and one member shall be a veteran who resides in the City of Derby.

The terms of the appointed members of the Commission shall be as follows: two appointed members shall initially be appointed to serve three-year terms of office, two appointed members shall initially be appointed to serve two-year terms of office, and two appointed members shall initially be appointed to serve one-year terms of office. Thereafter, at the expiration of the original term of office of each of the six members, each may be appointed or his successor may be appointed for a term of three years, except that any vacancy shall be filled within 30 days for the unexpired portion of the term in the same manner as the original appointment. The member representing the Board of Apportionment and Taxation shall be appointed to serve a term that is concurrent with the term of the Board of Apportionment and Taxation.

At the first meeting of the calendar year, the Chairman of this Commission is to be appointed by a vote of the majority of the seven members of the Commission.
Such Commission shall have jurisdiction over all parks and playgrounds in the City.
A budget for operating expenses shall be submitted to the Board of Apportionment and Taxation annually.
The Commission shall be advised by the Board of Aldermen that all requests for any use whatsoever for any park or playground shall be the sole responsibility of the Park and Recreation Commission. Approval for non-City-sponsored activities in or on all parks and playgrounds shall require an affirmative vote of this Commission with the approval of the Board of Aldermen.
Such Commission shall provide recreation facilities and programs for the townspeople in particular with a priority to be given to youth programs, and that guidelines be drawn up as to the inclusion of out-of-town personnel in any recreation programs permitted by the Park and Recreation Commission.
The Parks and Recreation Director shall report at regular meetings to the Commission the activities sponsored on any park or playground in the City.
The Park and Recreation Commission shall hold regular meetings at such time as may be fixed by the Commission and at such other times as the Commission may determine and shall submit a report of each such meeting to the Board of Aldermen, listing its upcoming activities and any recommendations it may wish to make that improve the overall recreation and leisure time activities of the people of Derby.
