No person shall kindle or direct or authorize any person to kindle a fire in the open air within limits of the city without a permit therefor issued by the City Fire Marshal, except that papers and refuse may be burned in a covered metal container or incinerator having adequate openings in the bottom to ensure good combustion but having no opening over two inches wide or in a fireplace constructed of incombustible materials; provided, however, that in no case shall garbage be burned in any incinerator.
No incinerator shall be placed within three feet of the property line or within 10 feet of any combustible materials.
No incinerator shall be used by any person other than the owner or occupant of the premises on which the incinerator is located except where such user has obtained the written permission of the owner of such premises and filed the same with the City Fire Marshal.
It is not the intent of this article to prohibit the use of outdoor cooking fireplaces or barbecue pits, provided that such use causes no fire hazard.
