[Adopted 9-23-1976 as Art. II of Ch. 10 of the Charter and Revised Ordinance]
The sale, discharge, firing or use of firecrackers, rockets, torpedoes, roman candles, fire balloons, fireworks, pistols, canes, cannon and other appliances using blank cartridges or using caps containing chlorate of potash mixture or any combustible or explosive composition of any substance or combination of substances designed or intended to produce a visible or audible pyrotechnic effect by combustion, explosion, conflagration, deflagration or detonation is hereby prohibited within the city limits, except when done under municipal auspices or when permitted by special authority of the Board of Aldermen as provided in this article.
The Board of Aldermen may, upon written petition addressed to it and filed in the office of the City Clerk, grant to such persons and aggregations of persons as it may determine from time to time permission for the public display of fireworks and pyrotechnics outside the fire limits, under the supervision of the Fire Commissioner and the Mayor, provided that no permit shall be granted unless upon written petition for the same, giving the place, date and time of day where it is proposed to hold such display and the names of the person or aggregation of persons under whose auspices the same is to be held, together with a general description of the character of fireworks or pyrotechnics proposed to be used and the occasion, reason for or purpose in making such display; provided, further, that all displays shall at all times be under the supervision of persons skilled in the discharge of fireworks who are approved by the Fire Commissioner and the Mayor.
Any person who shall violate any provisions of this article or fail to comply therewith shall be fined in accordance with § 1-14, provided that any of such articles may be sold to the city for the purpose of municipal display and to any person or aggregations of persons who shall be granted permission to make such public display pursuant to the provisions of this article.
