No person shall burn any paper, trade waste or other material at any outdoor fire within the corporate limits of the Town.

The use of firepits, firebowls, chimineas and other similar appliances (collectively, "firepits") is permitted within the corporate limits of the Town, subject to the following conditions:
A. 
Firepits may only be used on residential property and in the presence of at least one individual who is 18 years of age;
B. 
Firepits must be used in accordance with the manufacturer's guidelines;
C. 
Firepits must be used at least 30 feet away from any non-single-family dwelling or structure and should be at least 15 feet away from any townhouse, duplex or detached home;
D. 
The area around the firepit should be kept clear of any combustible material;
E. 
Firepits should not be stored on a balcony or deck;
F. 
Only dried, aged wood, kindling and tinder may be used in a firepit;
G. 
The burning of any trash, yard waste, construction material or debris, flammable or combustible liquid or other materials other than those permitted by Subsection F above is prohibited;
H. 
A source of water must be available;
I. 
Smoke from the firepit shall not cross property lines; and
J. 
All ashes from the firepit must be disposed of in a safe manner.

A violation of this chapter shall be a Class A municipal infraction and punishable as set forth in Chapter 115, Misdemeanors and Municipal Infractions, of the Town Code.
