Township of Penn, PA Article II Warrantless Arrests

§ 42-5 Right of police officers.

A police officer of the Township of Penn shall, upon view and upon probable cause when there is ongoing conduct that imperils the personal security of any person or endangers, public or private property, have the right to arrest without warrant any individual committing a summary offense in violation of the following Sections of Title 18 of the Pennsylvania Crimes Code:

A. 18 Pa. C.S.A. § 5503 (relating to disorderly conduct).

B. 18 Pa. C.S.A. § 5505 (relating to public drunkenness).

C. 18 Pa. C.S.A. § 5507 (relating to obstructing highways and other public passages).

D. 18 Pa. C.S.A, § 6308 (relating to purchase, consumption, possession or transportation of liquor or malt or brewed beverages).

§ 42-6 Procedures.

Any officer of the Township of Penn making a warrantless arrest for the violations set forth in § 42-5 above shall follow the procedures set forth in the Pennsylvania Rules of Criminal Procedure and, in particular, Pennsylvania Rule of Criminal Procedure No. 71 as in effect as of the date of the adoption of this article.

§ 42-7 Compliance with statutes.

In the event that the Commonwealth of Pennsylvania either amends 42 Pa. C.S.A. § 8921 or the Pennsylvania Rules of Criminal Procedure are amended as the same may relate to either an arrest without warrant or the procedure to be followed after an arrest without warrant is made, the police officers of the Township of Penn shall comply with the then existing amended or updated rule or statute.

§ 42-8 Intent.

This article is not intended to modify, restrict or otherwise prohibit a police officer of the Township of Penn from making any other warrantless arrests for summary offenses where such arrests have been expressly authorized by either statute or Rule of Criminal Procedure.
