A. 
The Borough of Carteret Planning Board, after due consideration and in conformance with the Local Redevelopment and Housing Law, (N.J.S.A. 40A:12A-1 et seq., "Redevelopment Law"), has recommended the adoption of the Middlesex Avenue Residential Redevelopment Plan prepared by Beacon Planning and Consulting Services, LLC, dated October 4, 2005 ("redevelopment plan"), for the Middlesex Avenue Residential Redevelopment Area established by Resolution No. 05-246 ("MARRA"), with the area of the MARRA shown as Figure 2 of the redevelopment plan; and
B. 
The redevelopment plan proposes development guidelines for the development of the MARRA as set forth in Section 3.0 et seq. of the redevelopment plan; and
C. 
The redevelopment plan is in furtherance of the goals and objectives of the Borough with respect to the MARRA and the Redevelopment Law; and
D. 
The Borough Council of the Borough of Carteret has reviewed the redevelopment plan and held a public hearing about the redevelopment plan to receive the comments of the public and interested parties; and
E. 
The redevelopment plan will be attached hereto as Exhibit A upon adoption of this article and is presently on file with the Borough Clerk's Office for review.
F. 
The Carteret Redevelopment Agency is hereby designated as the Borough’s redevelopment entity for the Washington Avenue Redevelopment District for all purposes of law, including without limitation the Redevelopment Law, and is hereby authorized to exercise all of the functions of a redevelopment entity, in accordance with the Redevelopment Law, as directed by the Borough.

(1) 
Each of the Mayor or the Chief Financial Officer of the Borough (each an “authorized officer”) is hereby authorized and directed to execute and deliver, and the Borough Clerk is hereby further authorized and directed to attest to such execution and to affix the corporate seal of the Borough to, any agreement, document, instrument or certificate deemed necessary, desirable or convenient by the authorized officers or the Borough Clerk, as applicable, in their respective sole discretion, after consultation with such counsel and any advisors to the Borough (collectively, the “Borough consultants”), to be executed in connection with the designation of the Agency as the redevelopment entity for the Washington Avenue Redevelopment District, the implementation of the Washington Avenue Redevelopment Plan, and the consummation of the transactions contemplated thereby, which determination shall be conclusively evidenced by the execution of each such agreement, document, instrument or certificate by the party authorized hereunder to execute such agreement, document, instrument or certificate, and perform such other actions as the authorized officers deem necessary, desirable or convenient in relation to the execution and delivery thereof.

All actions of the authorized officers and the Borough consultants taken prior to the date of adoption hereof in connection with the Washington Avenue Redevelopment District and the implementation of the Washington Avenue Redevelopment Plan are hereby ratified and approved.

The redevelopment plan is adopted as the official redevelopment plan for the MARRA, in accordance with the Local Redevelopment and Housing Law.
The Zoning District Map of the Borough's Land Development Ordinance is hereby amended to reflect the applicability of the redevelopment plan to the MARRA, and the Borough's Land Development Ordinance as it affects the MARRA is hereby superseded by the redevelopment plan to the extent set forth therein.
