It shall be the duty of the owner or owners of lots or grounds fronting
on or along such street or alley to keep in repair such sidewalks, curbs and
gutters in front of his, her or their lots or grounds, and upon failure of
such owner after notice to repair, the Borough may cause the repairing of
such sidewalks, curbs and gutters to be done at the cost of such owner and
may collect the costs thereof and an additional 10%, together with all charges
and expenses, from such owner, and may file a municipal claim therefor or
collect the same by action in assumpsit. At the time repairs are made to sidewalks,
curbs or gutters at those places where a sidewalk, curb or gutter abuts an
angle formed by intersecting streets or alleys, there shall be constructed
a concrete ramp to enable handicapped persons to make the transition from
street to sidewalk.
Whenever sidewalks, curbs and gutters are laid along any of the streets
or alleys of the Borough of Pen Argyl where the Council has by resolution
established the width and the elevation of the grade, the owner or owners
of lots and grounds concerned shall make application to the Mayor, and the
Borough Engineer shall furnish in writing the elevation of the grade in accordance
with which the sidewalks, curbs and gutters shall be laid, and thereafter
whenever such grade or elevation shall be changed by authority of Council,
necessitating a change in the elevation of the grade of such sidewalks, curbs
and gutters, such change shall be made at the cost and expense of the Borough.
