A certain document, three copies of which are on file in the office of the City Clerk of the City of Oil City, being marked and designated as the "International Fire Code," including Appendix Chapters B, C, D and E, 2000 Edition, as published by the International Code Council Inc., be and hereby is adopted as the Fire Prevention Code of the City of Oil City in the Commonwealth of Pennsylvania for regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous materials and devices and from conditions hazardous to life or property in the occupancy of buildings or premises in the City of Oil City and providing for the issuance of permits for hazardous uses or operations; and each and all of the regulations, provisions, conditions and terms of such International Fire Code, 2000 Edition, published by the International Code Council, on file in the office of the City of Oil City, are hereby referred to, adopted and made a part hereof as if set out in this chapter, with additions, insertions, deletions and changes as prescribed in § 166-3 of this chapter.
Ordinance No. 2622 of the City of Oil City, entitled "The Fire Prevention Code of the City of Oil City,"[1] and all other ordinances or parts of ordinances in conflict herewith are hereby repealed.

The following sections are hereby revised as follows:
101.1 Title. These regulations as set forth herein shall be known as the "Fire Prevention Code of the City of Oil City," and are herein referred to as such or as "this code."
102.1 Construction and design provisions. The construction and design provisions of this code shall apply to:

Structures, facilities and conditions arising after the adoption of this code.
2.
Existing structures, facilities and conditions not legally in existence at the time of adoption of this code.
3.
Existing structures, facilities and conditions when identified in specific sections of this code.
4.
Existing structures, facilities and conditions which, in the opinion of the Code Official, constitute a distinct hazard to life or property.
105.6 Required operational permits. The Code Official is authorized to issue operational permits for the operations set forth in Sections 105.6.1 through 105.6.46.
105.6.4 Carnivals and fairs. An operational permit is required to conduct a carnival or fair.
105.6.31 Open burning. An operational permit is required for kindling or maintaining of an open fire or a fire on any public street, alley, road or other public or private ground. Instructions and stipulations of the permit shall be adhered to.
105.6.36 Pyrotechnic special effects material. An operational permit is required for use and handling of pyrotechnic special effects material.
105.1.1 Payment of fees.
A.
A reinspection fee of $50 shall be assessed after due notice has been served in accordance with the terms and provisions of Section 109.2.3 and the violation, illegal action or unsafe condition continue.
109.3 Violation penalties. This section shall be revised to read in its entirety as follows:
Any person, firm or corporation who shall violate any provision of this code shall, upon conviction thereof in a summary proceeding before a Magisterial District Judge, be sentenced to pay a fine of not less than $300 or more than $1,000, together with the costs of prosecution and any fee or fees or be imprisoned for a period not to exceed 30 days, or both. Each day that a violation continues after due notice has been served shall be deemed a separate offense.

108.1 Application for appeals. A person shall have the right to appeal a decision of the Code Official to the Board of Appeals. An application for appeal shall be based on a claim that the true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted and the provisions of this code do not fully apply. The application shall be on a form obtained from the Code Official within 20 days after the notice was served.
The limits referred to in Section 3301.3 of the International Fire Code, 2000 Edition, in which the storage and use of explosive materials is prohibited, are hereby established as follows: the City limits of the City of Oil City.
