WHEREAS, the New Jersey Legislature has enacted a statute (P.L. 1977, c. 202) authorizing a municipality to enact an ordinance establishing restricted parking in front of residences for use by qualifying amputees who have been issued special vehicle identification cards by the Division of Motor Vehicles pursuant to the provisions of N.J.S.A. 39:4-205; and
WHEREAS, the Town of West New York wishes to establish restrictive parking spaces in front of the residences of qualifying amputees who have been issued vehicle identification cards by the Division of Motor Vehicles:
The Director of Public Safety is hereby authorized and directed to designate and establish a restrictive parking space in front of the residence of any qualifying amputee who has been issued a vehicle identification card pursuant to the provisions of N.J.S.A. 39:4-205.
A. 
The said restrictive parking space may be used only by the motor vehicle of the qualifying amputee residing at the dwelling located proximate to the said space and only when said motor vehicle displays a certificate for which a special identification card has been issued pursuant to N.J.S.A. 39:4-206.
B. 
No other person shall be permitted to park in said space. Any person violating this chapter shall be punishable as follows:

(1) 
First offense: $250.
(2) 
For each subsequent offense: $250 and up to 90 days of community service, to be determined by the court.
(3) 
In addition, the violator shall bear the full cost of towing, removal and storage of the violator's vehicle.
A restrictive parking space shall be established only after the qualifying amputee has been issued a vehicle identification card by the Director of Motor Vehicles and after he makes application therefor in writing to the Director of Public Safety.
When a restrictive parking space is established, the Director of Public Safety will post the appropriate marking or sign at the space.
