As used in this article, the following terms shall have the meanings indicated:
PLACE OF PUBLIC ASSEMBLY
Any church, religious or charitable use, structure, private school, auditorium, stadium, social hall, fraternal hall, theater or any place of public assembly where 10 or more persons are scheduled to occupy or congregate in any part of the structure more than one day during each calendar year for religious, charitable, social or civic purposes. This definition shall apply regardless of whether the assembly is originated by the owner or renter of the structure. In the event this definition is sought to be interpreted and as an aid to construction, the building or structure to which this article shall apply shall be any building or structure which can reasonably be construed to be within the meaning of N.J.S.A. 54:4-3.6 as made, provided and amended; provided, however, that this article shall specifically exempt and exclude any public school of the Town of West New York which is organized and operated pursuant to Title 18A of the New Jersey Statutes Annotated, Miller Stadium and any building or structure used for federal, state, county or municipal government purposes, including any building or structure used for federal, state, county or municipal election purposes, pursuant to Title 19 of the New Jersey Statutes Annotated, and any building or structure to be used and occupied exclusively as a residence for the physically or mentally handicapped, senior citizens or for hospital or public health clinic purposes.
Each existing place of public assembly as hereinbefore defined in § 414-83 hereof shall be required to comply with this article in the event it seeks to expand its present building or structure to accommodate more than 10 persons in excess of its assembly capacity on the effective date of this article.
Each existing place of public assembly which shall seek to relocate its activities to another location in the Town of West New York or to acquire additional sites or locations within the Town of West New York shall be required to comply with this article. In the event of additional sites or locations, the requirements of this article shall only apply to the new site or location.
Each organization seeking to establish a new place of public assembly in a building or structure not heretofore authorized or permitted by the Town of West New York as a tax-exempt structure operated by a nonprofit organization shall be required to comply with this article.
A. 
Each place of public assembly as hereinbefore defined in § 414-83 shall provide private off-street parking facilities of one car space nine feet wide and 20 feet in length for every five persons or fraction thereof who shall be able to be accommodated in the structure at any single assemblage, i.e., if the structure is determined to accommodate 100 persons, then the organization shall provide 20 off-street private parking facilities.
B. 
The off-street private parking facility required in Subsection A shall be located within a two-block radius from the site of the place of public assembly.
A place of public assembly which is not presently located in a structure which is presently granted tax-exempt status by the Tax Assessor of the Town of West New York shall be prohibited from locating within a one-fourth-mile radius of any other place of public assembly, as hereinbefore defined.
On or after the effective date of this article, the appropriate officials of the Town of West New York shall file with the Town Clerk a schedule listing the name and address of each place of public assembly located within the Town of West New York which has heretofore been granted tax-exempt status and listing the number of persons which can presently congregate in the structure on any single occasion in compliance with fire, safety and health standards and codes.
After the effective date hereof, any organization or entity which is not in compliance with this article shall be denied a building or occupancy permit for occupancy of a structure as a place of public assembly, as hereinbefore defined.
