No person, persons, firm, corporation, association or organization shall cut, dig, break or otherwise make any opening in a street, road or highway within the Township of Haddon until a permit shall have been obtained and fees paid as provided by Chapter 111, Fees.

The applicant shall, at his own cost and expense, make or cause to be made all necessary excavations in the street or highway; shall cause the paving and earth so excavated to be deposited in a manner which will occasion the least inconvenience to the public; shall cause the paving, flagging, roadbed and curbing to be restored as quickly as possible to as good a condition as same was prior to the excavation, using the same materials as existing prior to the excavation; and shall also be responsible for all damage by reason of such excavations and for the imperfect filling in of same. In some cases where the road, highway or street must be opened at night, same must be barricaded and marked with proper damage signals.
No person, persons, firms, corporation, association or corporation shall cause willful damage or malicious damage to any part of the Township's highway and road system.
Any person, persons, firm, corporation, association or organization who shall violate any of the terms of the provisions of this article shall, upon conviction, be subject to imprisonment for a term not to exceed 90 days or a fine not to exceed $1,000, or both. Each day the violation of the terms or provisions of this article shall continue shall constitute a separate offense.
