No person other than a person authorized by the Borough shall uncover, make any connection with or opening into, use, repair, alter or disturb any public sewer or building sewer lateral and the appurtenances thereof.
A.
If no building sewer lateral is available, the property owner shall, prior to the issuance of a certificate of occupancy, apply to the Borough Clerk to have a building sewer lateral installed.
B.
Each application shall be accompanied by payment of a fee as provided in Chapter 138, Fees, which is hereby fixed as a minimum charge. If, because of the nature and extent of the work to be done or the pavement or terrain to be penetrated, or the width of the road, or any like circumstances, the said sum as provided in Chapter 138, Fees, shall not be sufficient to cover the costs and expenses of the Borough, the Borough Engineer or such other official or department as the Borough may designate shall fix the fee at a higher figure to cover fully all the costs and expenses of such installation. Any cost or expense in excess of the sum paid with the application shall constitute a lien against the property until paid.[1]
