As used in this chapter, the following terms shall have the meanings
indicated:
Includes persons, sole proprietorships, associations or other business
entities wherein at least one (1) person is a certified professional exterminator
engaged in rodent elimination or eradication by use of rodenticides approved
by the New Jersey Department of Environmental Protection. Wherever in this
chapter work is to be conducted by a professional exterminating firm, the
work must be supervised by a licensed professional exterminator.
Includes persons certified by the State of New Jersey, Department
of Environmental Protection as competent and authorized to use or supervise
the use of pesticides who is engaged in rodent elimination or eradication
by use of rodenticides.
The act or acts ridding a property of obstructions, entanglements
or obstacles, including trees and other growth, provided that the area affected
is five hundred (500) square feet or more.
The erection, alteration or repair of any building or structure as
requires municipal approval or a building permit.
The act or acts of pulling down, tearing down or otherwise leveling
all or part of a building or structure as requires municipal approval or a
building permit.
The act or acts of digging up or uncovering or removing soil or material
used as the foundation of a building or a structure as requires municipal
approval or a building permit.
Includes the Health Officer or Code Compliance Officer or any duly
authorized agent or employee of the Board of Health or Code Compliance Office,
Borough of Hillsdale, County of Bergen, New Jersey.
Includes any person, persons, partnerships, firm, association, corporation
and the owner of buildings or property subject to demolition, construction
or excavation.
Includes any vacant land or structure, whether public or private,
or whether adapted for vacant land or any use.
Includes the elimination or eradication of rats, mice and other rodents
on said real estate premises such that said real estate premises are completely
freed of such rodents or there is not evidence of rodent infestation remaining
after implementation of accepted measures such as poisoning and other means
approved by the Health Officer.
A.Â
It shall be the duty of any person engaged in the demolition,
construction, excavation or clearance of any real estate premises in the Borough
of Hillsdale to first secure approval from the Health Department/Code Compliance
Office before commencement of such demolition, construction, excavation or
clearance.

Before granting permission for the demolition, construction,
excavation or clearance of any real estate premises, a certified professional
exterminator shall inspect the premises and the immediate surrounding premises
to determine whether evidence of rodent infestation exists in or about said
real estate premises.
C.Â
In the event that inspection reveals evidence of rodent
infestation, the Health Department/Code Compliance Office shall require a
program of rodent extermination undertaken and completed by a certified professional
exterminating firm. The program for rodent extermination in the case of vacant
land shall be baiting or dusting burrows approved by the Health Department/Code
Compliance Office until results of said baiting indicate to the satisfaction
of the Health Department/Code Compliance Office that rodent infestation is
nonexistent or eliminated.

Thirty (30) days prior to commencement of demolition,
construction, excavation or clearance, a certificate shall be issued by the
Health Department/Code Compliance Office.
E.Â
After completion of a rodent extermination program as
required herein, the Health Department/Code Compliance Office shall reinspect
the premises and upon determination that the program has been effective, shall
issue a certificate from the Board of Health signifying its approval of said
extermination.
F.Â
Notwithstanding the issuance of a certificate of approval,
in the event that evidence of reinfestation of said real estate premises is
discovered by the Health Department/Code Compliance Office, then, prior to
demolition, construction, excavation or clearance, the foregoing provisions
of this chapter shall apply, and new request for permission to demolish, construct,
excavate or clear shall be made by the persons required herein.
G.Â
Notification of the Code Compliance Officer. The Board of Health, upon issuing a certificate of approval as set forth in § 331-2, shall notify the Code Compliance officer of the Borough of Hillsdale of said issuance. The issuance of a certificate of approval shall be a condition precedent to the issuance of any permits pursuant to N.J.A.C. 5:23, the BOCA National Building Code and municipal ordinances.

When in the opinion of the Health Officer/Code Compliance
Officer or their designee, whenever a situation exists which may contribute
to the breeding or propagation of rodents, including but not limited to uncovered,
overflowing or poorly maintained garbage and garbage receptacles, accumulated
debris, wood, branches, logs, leaves, compost piles, accumulated junk, abandoned
materials or the feeding of animals, the condition shall be removed by the
property owner after issuance of a violation notice or verbal order. The Health
Officer/Code Compliance Officer shall also have the power to order extermination
on private property by a certified professional exterminator and require a
written report from the exterminator as to methods, chemicals and follow-up
visits used to abate a rodent situation. If the property owner does not comply
with violation notices in the time prescribed by the Health Officer/Code Compliance
Officer, said officer may order the property to be cleaned and exterminated
at the property owner's expense. Said expense will be attached as a tax lien
against the property.
Any person who shall violate any provisions of this chapter shall, upon
conviction, either be imprisoned in the county jail or other place provided
by the municipality for the detention of prisoners for a term not exceeding
ninety (90) days, or shall be liable to a penalty of not less than five dollars
($5.) nor more than five hundred dollars ($500.).

Upon application to the Code Compliance Office for a permit for demolition or construction of any premises, the applicant shall pay, in addition to any other fees, an application fee as provided in Chapter 335, Fees, to the Health Department.
