A. 
Whereas, pursuant to N.J.S.A. 40A:9-141, there is hereby created and established in and for the Borough of Middlesex the position of Tax Collector; and
B. 
Whereas, as a condition of eligibility for appointment and for continuation in office the Tax Collector shall be required to hold a Tax Collector Certificate issued by the New Jersey Division of Local Government Services pursuant to N.J.S.A. 40A:9-145.2; and
C. 
Whereas, the duties and responsibilities of the Tax Collector shall be in accordance with N.J.S.A. 40A:9-140 through 40A:9-145 under the supervision of the Mayor and governing body; and
D. 
Whereas, the Tax Collector is the official charged with collecting of taxes upon real and personal property in the municipalities, whose duties shall include the following: 1) lien enforcement; 2) tax collecting; 3) tax billing; 4) cashiering; 5) tax reporting; and 6) enforcement of tax collection; and
E. 
Whereas, the Tax Collector shall receive such compensation as is limited by the salary ordinance and set by resolution, as may be amended from time to time; and
F. 
Whereas, the Tax Collector shall be appointed by the Mayor and Council and the term of office shall be for four years in accordance with N.J.S.A. 40A:9-142; and
G. 
Whereas, subsequent to January 1, 1982 a Tax Collector cannot be recognized as having tenure of office unless he/she: 1) holds a tax collector certificate; 2) holds the office of tax collector not less than four consecutive years; and 3) receives appointment; and
H. 
Whereas, removal from office as Tax Collector shall be in accordance with N.J.S.A. 40A:9-145.8(c), with "good cause" set forth in accordance with N.J.S.A. 40A:9-145.8(d).
The governing body does hereby create the position of Tax Collector.
