No person shall engage in the business of tattooing or shall operate any establishment where tattooing is performed or shall tattoo any other person without obtaining a license to do so from the Middlesex Borough Board of Health and without complying with the other requirements of this chapter.

The initial fee for the license required to engage in this business in the Borough of Middlesex shall be $1,000, and thereafter there will be a renewal fee of $500 paid yearly. The license to be issued shall be valid until May 31 of the year immediately following the year that the license was issued hereunder.
Every person engaged in the practice of tattooing shall at all times comply with all the following requirements:
A. 
All tattooing applications and other related procedures are to be carried out in a clean, safe and sanitary manner so as to minimize the danger of infection to the person to be tattooed.
B. 
The tattooing establishment shall be maintained in a clean and sanitary manner in compliance with all applicable ordinances, regulations of the Borough of Middlesex and statutes, rules and regulations of the State of New Jersey, including the New Jersey State Sanitary Code, Chapter VIII, N.J.A.C. § 8:27-1 et seq., as now constituted and as same may be amended in the future, it being the intent of the Borough to incorporate the standards set forth in the State Code, as now constituted and as same may be amended, as part of its rules and regulations.
No person or operator shall state or imply in any advertisement that the tattooing establishment is endorsed, regulated or approved by the Borough of Middlesex or by any department or official thereof or is conducted in compliance with the terms of this chapter.
Any person violating any of the provisions of this chapter shall, upon conviction, be subject to a fine not to exceed $1,000 or imprisonment not to exceed 30 days, or both.
