No festival or affair of like nature shall be conducted on public streets, sidewalks, rights-of-way or other Borough property until the sponsor desiring to conduct the affair shall have made and signed a written application to the Mayor and Council for an operator's license, in the form provided by the Borough, not less than two weeks prior to the first day of operation of the proposed festival.
The issuance of the festival operator's license shall be further conditioned upon the following:
A. 
Permission from the Mayor to close the street or streets, public right-of-way or sidewalks.
B. 
All license applications shall be commented on by the Fire Department, Board of Health and Police Department of the Borough of Middlesex.
C. 
The sponsor's executing and indemnification agreement on behalf of the Borough of Middlesex, substantially as follows:
The sponsors hereby represent, stipulate, contract and agree that they do jointly and severally indemnify and hold harmless the Borough of Middlesex against all liability for any and all claims for damages to property or injury or death of persons arising out of or resulting from the issuance of the license or conduct of the public at and during the life of the festival.
D. 
Written approval from all residents on the block or blocks to be closed for the event.
No alcoholic beverages shall be sold, served or consumed, and no games of skill or chance shall be conducted during the operation of the festival unless and until the sponsor obtains all required permits as specified by Borough ordinance or state law.
The duration of a license for a festival shall be for not more than one daily time period between the hours of 11:00 a.m. and 11:00 p.m. on Saturdays and holidays (except those holidays falling on a Sunday) and 12:00 noon to 10:00 p.m. on Sundays. Each license issued shall contain a provision for a rain date.
The issuance of a license shall be subject to approval of the Mayor and Council, which body reserves the right to add any conditions it deems necessary in addition to the requirements of this chapter. License approval shall be subject to the sponsor's hiring of a special police officer(s), who shall be present during the festival at the sponsor's' sole cost and expense.
